Let’s scare HR - How to form a Union

Come on, it’ll be funny:

General Steps to Form a Union in the U.S.

  1. Build Internal Support

Identify Allies: Find coworkers who share concerns about wages, benefits, or working conditions.
Form an Organizing Committee: Create a small group of trusted employees to lead the effort.
Maintain Confidentiality: Be aware that while discussing unionization is generally protected, companies may have strict policies about solicitation during work hours or in work areas.

  1. Contact a National Union

Reach out to an established national union (e.g., United Steelworkers, Oil, Chemical and Atomic Workers International Union) that has experience organizing in the energy sector. They provide resources, legal guidance, and campaign strategies.

  1. Sign Authorization Cards

Employees sign cards indicating they want the union to represent them.
To petition for an election, typically 30% of the bargaining unit must sign, but unions usually aim for 60-70% to ensure a win.

  1. File for an Election (NLRB)

The union files a petition (RC petition) with the National Labor Relations Board (NLRB).
The NLRB determines the appropriate "bargaining unit" (which employees are eligible to vote).
A hearing may be held if the employer disputes the scope of the unit.

  1. Campaign Period

Once the election date is set (usually 3-6 weeks later), both the union and the employer campaign.
Employers are legally allowed to express their views against the union, provided they do not threaten, coerce, or promise benefits to influence votes.
Unions campaign on the benefits of collective bargaining.

  1. The Election

Secret ballot election is held, often supervised by the NLRB.
If 50% + 1 of the voting employees vote "Yes," the union is certified.

  1. Collective Bargaining

Once certified, the employer is legally required to bargain in good faith with the union representatives to reach a contract.
Important Context for Texas and Energy Sector
"Right-to-Work" Laws: Texas is a right-to-work state. This means employees cannot be forced to join a union or pay union dues as a condition of employment, even if the union wins the election. This can impact union funding and membership density but does not prevent the formation of a union.
At-Will Employment: Texas is an at-will employment state. While the NLRA protects employees from being fired specifically for organizing, proving that a termination was due to union activity (rather than performance or restructuring) can be legally complex and requires strong evidence.
Legal Counsel: Because of the complexities involved in the energy sector and potential legal challenges, consulting with labor attorneys is a standard recommendation for anyone considering this path.

Time to come out of the shadows

You have the right to join with coworkers to address conditions at work. You have the right to form, join, or assist a labor organization for collective bargaining purposes or work together with coworkers to improve terms and conditions of employment. This protection extends to certain work-related conversations on social media. For example, employees have a right to address work-related issues and share information about pay, benefits, and working conditions with coworkers on social media platforms like Facebook, X, YouTube, and others.
You can’t be fired, disciplined, demoted, or penalized in any way for engaging in these activities.

Union now!

CWA is actively organizing tech and banking workers across the industry, and they've already delivered results. At California's Beneficial State Bank, CWA members won the first union contract in 40 years in 2021, securing higher wages, increased retirement contributions, and just-cause protections against unfair discipline. Right now, workers at 29 Wells Fargo branches and counting have voted to join Wells Fargo Workers United, a CWA division, proving that major banks can be unionized. CWA brings over 367,000 members strong across telecom, media, tech, airlines, and now banking—giving you a powerful voice backed by an established national infrastructure. Unlike dealing with management alone, CWA has the expertise and resources to fight for your interests at the bargaining table.
CWA directly addresses the working conditions that matter most to you: pay equity and flexibility. The union has made work-life balance and remote work policies key organizing priorities, especially after seeing how forced return-to-office mandates have hurt tech talent and worker wellbeing. The reality at major banks is that workers are falling behind—long-term employees seeing new hires brought in at higher pay rates, software developers without proper desk setups under hybrid arrangements, and wages that aren't keeping up with inflation. CWA fights for transparent, fair pay scales with regular raises and the flexibility to work remotely, protecting you from arbitrary management decisions. With a union contract, you get guaranteed grievance procedures, just-cause protections, and the collective bargaining power to actually negotiate better terms instead than accepting whatever management dictates. The banking industry is heavily unionized everywhere else in the world—it's time the U.S. caught up, and CWA is leading the way.

ProPublica Union Stages 24-Hour Strike

Unionized ProPublica staff began a 24-hour strike. They are protesting issues including AI use, layoff protections, and wages. The ProPublica Guild unionized in 2023 and is negotiating its first contract. Management's unilateral AI policy prompted an unfair labor practice charge. This marks the first work stoppage for the nonprofit newsroom's employees.

$50B this year

How was your raise? Did you get a full share of the bonus? College kids coming in and making more than tenured workers who have earned their stripes. A useless Tell Dell coming Monday. Franklin is the leading revenue generating plant in the company and they are using you up and spitting you out. Make some real noise and unionize.

If you think youre at risk of losing your job - some tips

I know a lot of us are worried about our jobs. I keep hearing something is coming around the end of Q2. Just thought I'd offer some tips to protect your backside (and open up the chance for other people to chip in) if something happens to you. Some of these will obviously depend on your country* etc but:

1) Download/get a copy of your employment contract (and any other associated paperwork). You should be able to download this in Fusion - personal information - document records. Do not just save it to your work laptop. Make sure to keep a copy on your own computer or wherever you can reach it in case you lose access to your work area/laptop. - This is to ensure you know the exact terms you were working to and your entitlements.

2) If you're part of any Pearson schemes or pensions, make sure to get records of that, what you've paid in, etc., any terms of schemes in reference to redundancy, and information you may need to access them if you lose access internally. It may be a pain to get the info externally.

3) Any work (that's not sensitive) you may want to use as examples for jobs in the future, make sure to save that not on your work laptop but somewhere like a secure file area or USB you can access externally.

Optional

You may want to consider joining a relevant union*, which usually offers guidance and support, especially if you think something's been done unlawfully/unfairly.

If you end up being moved to another role that's not suitable (perhaps in the hopes of them making you leave rather than paying out for redundancy), this is where having your contract will come in handy, if there isn't a clear violation (perhaps due to vagueness in your contract). You need to keep a record of everything in writing and make it clear that you have not agreed to the changes and are working 'under protest' while it gets addressed (this is where a union may come in handy).

Please feel free to add any other tips here, trying to be helpful. Hate to see people get shafted by big companies and want us to be prepared if something should happen.

So definitely the yearly package for Eisp union coming soon

I can see there will be the usual suspects Eisp offered to union field soon .But all the rumors of some huge enhanced one and a blanket everyone can leave one do not seem to be materialized. It seems it’s same usual yearly Eisp offered to limited numbers.I am very shocked I really though Dan wanted to get as many people off the pay roll as possible.I am starting to think he is more concerned about the management .I am going to assume it’s because they make a much higher salary then associates.Or I just honestly have no idea what plan is ,But going to be a lot of disappointment for field techs tht were hoping to go

Is it time for FIS Tech Dev to Unionize

I am sorry. I can only speak for the Tech people at FIS, but I am tired of watching my co-workers get laid off or moved to third party consultants to get laid off without severance. I am tired of wondering if I will have a job next quarter. I am tired of upper management lying to our faces. Those off-shore consultant firms pay their employees not even a quarter of what we make. If they are going to lay me off, it is not going to be to hire someone over seas making a quarter of my salary. What does everyone think?

Lack of info

There is nothing that can be done now. The one thing that bothers me to no end at all these extensions recently. We, as the people who will be represented by the contract, never see what the union(s) even asked for to start negotiations. Was there any give and take? Or, did they just be-doverand take what the company gave? This should be information supplied to all members, all locals.

Ratification number are sad for ibew wonder what the cwa break down is no one voted so they now can say it passed overwhelmingly

Sad look at the ibew number some areas barely half of the eligible voters voted .If the not voting was supposed to send a message how d-mb .If they wanted to send a message it should have been a vote no.The only votes that were cast were the cronies of the union leaders the no votes were members who care the rest didn’t vote so they can’t say anything in my book but one things for sure after 2 separate strikes where we had them where we wanted them and the union unexpectedly sent us back to work right before both times there were major natural disasters we would have had them over a hole but instead we were forced 16 hour days while they sent us back to work in good faith while giving away our contract this is it for me I think it’s time I stop paying my dues their pretty much useless ibew and cwa they now cemented that we will all need to work till Medicare age thanks might as well just ask for a bigger raise and forget saying we have retirees medical its unaffordable sad for the ones already in retirement

I voted no and here is what happens next.

It took 8 years for the union to get ba--s after the terrible 2008 contract. 2016 we went on strike and made modest gains.

We lost those ba--s.

8 years from now, Dan or whoever, will invoke the spirit of Lowell and come after us again. We should have stood our ground now so we won’t need to do it in 8 years. We could have made REAL gains today but now we will make only modest gains going forward.

So now that the contract is ratified here is what’s next and yes it’s not a great contract BUt

So let’s all just admit the extension is nothing great . our union leadership took what ever was offered after the company 2 times prior shut them down .So let me say I voted yes ,but I really am tired of the leadership in all locals patting themselves on the back .In the end they continued the scrw ing extension on the retirees and now the possibility of us retiring .The whole deal was Dan needed to settle to move to the next stage !!There will be major management layoffs and reorganizations .Then by end of year there will be basic Eisp offered to union associates probably across board .Anyone who wants out or can afford it will be allowed to leave .The final stage is yet to be determined but may include the separation break up of lines of business. After that if that happens the sky is the limit to be used sold off or spun off .One things for sure the contract extension is not the end but the beginning of the end for union and management in wha I would call the end days .So advise anyone with under 26 years or under 55 start looking for somewhere else to begin your career

Various Levers for Bringing Down Corporation Like This

Need to some reach on mass scale various groups and educate them on how corporation is failing their mission, customer base, and employee wellbeing:

1) Medicare Membership — Educate on Failure to Pay Catastrophic Claims or Expensive RX
2) Employees — Layoffs on US Citizens and replacing by means of AI and Outsourcing and H1B Visas. Is it time for an Employee Union?
3) Shareholders — are executives being legal and honest and forthright in their dealings and state of the company? Is there any insider trading going on by executives? Are there stock buybacks to mislead shareholders as to the state of the company’s health?
4) Government Officials — Seeing as how Medicare is funded with tax payer dollars, reach out to Mayor, Governor, State and Federal Senators and House of Representatives.
5) Church Pastors and Church Membership — Educate them on how Humana is failing their flocks in time of need from a healthcare standpoint.

7) Better Business Bureau, AARP, etc.
8) Unions such as Teamsters — as to how start a union for nurses and other employees.
9) SEC — as to any known insider trading you may be aware of.
10) Lawyers — File lawsuits when Humana has legally wronged you by unlawful termination that you have documented.
11) ICE — report expired H1B Visas or those continuing to work well past the legal amount of time of six years in US.
12) Social Media — get the word out and shame Humana from a PR standpoint about unethical behavior of the company on twitter, facebook, reddit, facebook, tiktok, LinkedIn, etc.

Union strong

If there was a union in Palm Bay, Maybe there wouldn’t be such massive layoffs.
Tomorrow is Thursday. We will see what happens. Texas is already getting RIFed big time.
Yes, there are union dues and other negative aspects, but if the union keeps your job, then it’s well worth it.
