Confused about WARN Act for Remote Workers

If we're laid off as fully remote, what if the WARN Act isn't added into our severance? Is there anything that can be done? I've heard about the class action lawsuit last year from a remote worker laid off last year who was working in CA but managers/work location were in NY and they didn't get WARN Act pay applied to them because they were remote. I think I'll only be getting 4 weeks severance if that's the case.

Are remote workers who don't live near LA/NY office just sc--wed because of some loophole for being remote?

Does the WARN filing mean 528 at HQ plus 287 at TNC?????
Or are remote and global roles missing?
I think TII would not be covered by the WARN notice as this is US only?
Am I wrong here?

Check your states WARN Act: 90 day notice if 50 or more people laid off in your state

Check your states rules on WARN ACT: Some states now requires a 90-day notice before a mass layoff or the closure of a facility, a significant increase from the previous 60-day notice. The state's law, known as the (your state) WARN Act, now applies if 50 or more employees statewide are laid off and includes part-time workers in the count. If the 90-day notice is not provided, employers must pay an additional four weeks of severance pay in addition to the mandatory one week of severance per year of service.

Employer "establishment": The definition of an "establishment" has been expanded to include all facilities in (your state), and layoffs at different locations may need to be aggregated to meet the 50-employee threshold. This includes remote employees who report to a (your state) location.

Severance pay: In addition to the 90-day notice, employers must provide severance pay of at least one week for every year of service. If the 90-day notice is not given, an extra four weeks of severance pay must be provided.


Dozens of Wisconsin workers losing jobs as Xylem announces layoffs

Xylem, Inc., a major American water technology provider with operations in Wisconsin, has announced it will be laying off dozens of employees at its Waukesha facility.

According to a Worker Adjustment and Retraining Notification (WARN) letter submitted to the Wisconsin Department of Workforce Development, Xylem will permanently reduce its workforce at the facility located at N19W23993 Ridgeview Parkway, Suite 200.

How many got LRed and existed out on Oct 13 after 60 days, are non-USA different dates?

Acknowledge if impacted this cycle. There are numbers out as large as 7000 LRed this cycle as notified on Aug 13, 2025 but there is no formal place to sum it up. Are WARN notices available and what age group employees with locations impacted…. This is a whole mix soup, everyone served different.

How is the job market outside… hearing pathetic stories…


WARN Act 1988

It would seem obvious that the WARN Act will be dismantled shortly since the bill was introduced by a senator who would be shunned today, and passed by a completely different type of congress than we see today. Not surprisingly Reagan did not sign the bill.
No question today's administration will ensure corporations have as much power to layoff as many workers without so much as a grunt. Removing guardrails meant to protect employees is their goal. Pay attention.


Look at your states WARN Notice

NJ WARN Notice. If Verizon lays off more than 50 people, they may be listed around 10/23.
But not sure if they have to be listed if they give employees 60 day notice. Nokia USA always gets away from being listed. Not sure how.

March 2026 Cuts

Ingersoll Rand Industrial U.S. Inc, known locally as Gardner Denver, filed an Illinois WARN notice indicating around 70 layoffs at its North Euclid Avenue facility in Princeton. The first layoff date in the filing is March 2026. The company manufactures compressors, blowers, and vacuum pumps. Local outlet 103.9 WLPO reports it has requested additional details from the company.

Yang Ming (America) Corp. Layoffs in Houston

Yang Ming (America) Corp. is closing its Houston customer service center at 3250 Briarpark Drive, Suite 201, laying off 118 employees starting November 30, 2025, with additional layoffs through March 15, 2026, per a Texas Workforce Commission WARN letter released October 8, 2025, and while the company did not provide a reason, it said the layoffs are permanent, operations at the site will cease, and some employees may be offered relocation to its New Jersey facility, with Yang Ming America headquartered in Newark, New Jersey.

What it means now: Starbucks to cut 974 Seattle, Kent jobs starting Dec 5

Starbucks filed a WARN notice saying 974 non-retail workers in Seattle and Kent will be laid off starting December 5, 2025, following last week’s disclosure of 338 statewide job cuts. TIAA's loss is Empower's gain.
