Accelera Belgium not respecting social agreement

Per the legally binding agreement between Cummins, the unions and the government, people laid off end March would receive severance payments of 3 or 6 months depending on age and/or seniority. At this point, Cummins failed to pay and hr replies with very vague messages to people enquiring.
The unspoken plan to let the entity go bankrupt without honoring the social plan seems to become reality.
But remember.... 'they care about you'!

Time for Some Reality

The smiling man is going to hold town halls in his vest and act like it's a great thing we're going bankrupt and then repeat the mantra "Focus on executing the WIN strategy." The same mantra he has used for every quarter of negative results. The same mantra used when we were told there would be no bonuses.

The fact of the matter is, revenue has declined for 4+ years and the executives have shown they are without any ideas to stop it. Project ATHENS was supposed to "stabilize" revenue whatever the he-l that means - but I can't imagine it meant it would just consistently go down.

The "Age of Possibility" was supposed to bring in new customers. Revenue dropped double digits.

The WIN strategy that has brought us millions of new customers? Revenue has declined EVEN MORE.

New people are being given keys to the shop after the bankruptcy. Don't expect the executives at Silver Point Capital to walk around and shake everyone's hand and talk about how excited they are to work with us. They will be about slashing every single line-item that doesn't make sense. Expect fulfillment to materially change - at least one ware house will close. Bookmark this.

The hedge funds aren't here to run a shopping channel indefinitely - they are here to make back their money by any means necessary. They aren't thinking long term. They are thinking 3 to 5 years.

Don't expect bonuses next year. You were kind of silly for expecting them this year. In addition, expect higher benefit costs at open enrollment

Rawlinson and company will stay as figure heads. They will give an air of stability that is needed - but they aren't in charge once the Summer is over.
You can start being real or you can continue to believe the nonsense spewed in the town halls that are as cheesy as the TV we produce.

QVC will be around indefinitely - but expect another big layoff. This time it won't just be office jobs. Customer service will be replaced by AI (As much as possible) and fulfillment will be modernized, "right sized" (you know what that means) and replaced by robots (as much as possible).

Hiding assets to not pay bills

Former owner, Richard Baker has been served. He is defying the inquiry

The first Neiman Marcus bankruptcy they stiffed creditors 2.667 billion.
Now it seems the property art. Worth millions was not reported . Baker claims he has no access to his email .so don't ask him. The goal is to cheat creditors for minimal. Repayment. Then blame the court when creditors aren't payed. Or for the low level returned to them , as compensation. While bonusing a select few who don't even need the money. Zero accountability. More dis honesty.

No Graceful Transition

At this point, it makes the most sense to file CH11 now and start a planned slide into restructuring, ensuring the best possible outcome and odds for survival. Save the company, and as many jobs as you can.

They will not do that.

As bad as things are, life is still pretty good in the command bunker. The EC is paid well and treated like royalty. They go to their F1 races, and attend sporting events in skyboxes with vendors they will eventually default on their line of credit with. It's nice, they run things, and have a comfortable standard of living; it is ideal.

What is not ideal is giving up control, giving up the perks, giving up the excessive compensation to drive the company into a ditch.

Actually saving the company would require sacrifice from the EC. They have chosen not to do that. Instead, they attend F1 races, spend lavishly (on themselves) and run out the clock on a company that could be saved. The company is an end to their means - nothing else. Whatever happens will be a lot worse that it needed to be, because they want to go to one more race, sit in one more skybox for a hockey game, lord over you for one more day, before a mandated bankruptcy trustee reined them in, and put an end to it.

Remember that when they say WE have to make sacrifices, WE have to do difficult things. WE, isn't we, it's YOU.

Bonuses and Cheating the employees

While the company lost 77 million last month. They asked the court to approve bonuses for 8;employees if certain targets are met in the bankruptcy. Isn't that the top brass job?
Employees on leave of absence right now arent paid what they are actually owed. They are paid a draw instead.
Pretty nasty to do that while employees on medical leave. Is there no level this company and Raemdonck won't stoop to.

Fireside Chat Coming your Way

If we had a honest fireside chat right now the following would need to be said; please add what else you think is missing
·      Xerox currently has a hiring and retention talent problem where we can’t hire or keep the right level of staffing. (Stated in 10k)
·      Xerox currently has 15-25% staff within positions that need to be re-organized into GBS positions sooner than later.
·      Xerox currently has 25-45% staff that need to be released with 25% being residue from the purchase of Lexmark.
·      Xerox when purchasing Lexmark made a mistake by acquiring $1.5 Billion in debt above and beyond the debt we already had on the books.
·      Xerox will not be able to make debt payments starting in 2027 and will most likely be filing Chapter 11 in 1st Quarter 2027.
·      Xerox is not paying vendors on timeframes favorable to the vendors to save money; every penny we get in interest is needed.
·      Our stock price in the next 90 days will go below $1.00 starting the count down till we are delisted or transferred to the penny stock section of the news paper.
