Most people are aware of these h1b practices. But complaints to DOJ trigger investigation and once investigation starts more things than we are aware of comes out and something will got to be changed. That is why these complaints are important. A lot of people have unfortunately missed the deadline. Hoping you guys will be able to do it within 6 months.

The IEEE has been after this for a while now. Maybe this latest attempt will get somewhere, who knows. H1B abuse is pretty common. The way the H1B system works, people on an H1B visa are supposed to be paid a wage competitive with Americans doing the same job. The government actually sets the wage at a certain number, The problem is a lot of people hired on an H1B are either only paid that wage on paper and not in an actual salary (very illegal) or the person is hired to be, say, a data entry person and paid that wage and then start doing engineering work. While that is supposed to be illegal, companies do it pretty often.

In response to @Flo92lT-wlq

The DOJ letter also says that the company that hires the contractor "could be considered a joint employer," meaning that the firm that engages an IT services firm that uses mostly H-1B workers and other foreign workers may have liability for this discrimination as well as the contractor.

"The business model raises a serious question of discrimination against U.S. citizens," said Morrison.

H1b is called the outsourcing Visa. The H1bs are brought in for knowledge transfer, happened to our team. The H1b are then sent back to India, phillipines, Bratislavia and they train others. More jobs are lost. H1b is the route to outsourcing. Saw this first hand. ATT first transferred the ATT employees to Vendor and told them to take them and contract them to ATT. Then the vendor laid off some of them and brought in more on H1bs and ATT is definitely aware of them. See websites where ATT chairman is asking for increases in H1b visas.

The truth is once complaints are filed especially in the department of justice, there is something like discovery process and ATT has to submit documents and the truth about H1b and outsourcing with contractors and offshoring all come out.

PEOPLE HAVE TO HAVE GUTS TO STAND UP FOR THEMSELVES FIRST and file complaints.

Check out this blog where people do know ATT and ALL TELECOM industries are doing this. And there is even an article on the blog

I do not think we have a big #H1B problem, our issues are mostly based on #outsourcing work #offshore

The problem is that ATT isn't really going the Visa route. They are outsourcing with contractors and offshoring.
