I've been through a few layoff cycles and I don't remember ever once an employee on a H1B visa or any other work visa getting let go. H1B visa holders are considered temporary workers. Why are full time employees let go before temporary employees? Soon all of Nike will be visa workers. The American dream is for everyone except Americans.

@f1 The ”prevailing wage” is set by the Department of Labor (DOL), using employer payroll wage data collected by the National Prevailing Wage Center (NPWC). We can see from the LCA example below, the prevailing wage falls in line based on the Job, Level, SOC, and Location. The bottom line, the prevailing wage is based upon a weighted average of actual wages that are being paid. It is useful info for ALL employees, not just H1B.

@ eb actually H1B visa wages are set federally and are usually higher than an American citizens in the same role. Many past managers of multiple companies have reported this and had to raise the wage of a position when it was offered to a H1B. This is because the company can set your wage but has to pay the minimum set federally for the job title for a H1B. And yes, this is true. It’s from the U.S. Department of Labor, which states that employers must pay the prevailing wage rate to ensure hiring a foreign worker does not undercut U.S. workers. Federal law does not require identical pay for U.S. citizens in the same job, but it does prohibit pay differences based on protected characteristics like s-x, national origin, or citizenship status.

@ca you do realize that contracting companies hire what we would call FTE's? they then contract out as "ETWs" to other companies. It seems like you are the one that doesn't understand how employment works

Up in Seattle at Boeing, during past RIFs Boeing management would go out of their way to hide their H1b’s to protect them from layoffs, so mostly only Americans got the axe. It wasn’t a rare occurrence either. Seemed like it was coming from orders above.
There are a lot of Indians in management at Boeing now. They only hire other Indians and don’t try to hide the fact or care what others say about what they are really doing.
Tell me you don’t the difference between ETW and FTE without telling me. And yes, visa workers were let go in the previous layoffs. Also when you terminate ETW contracts, it’s not a layoff!
The reality is that the more well off visa holders get "hired" by specialized contracting companies that act as temporary shields while they look for additional work.
@bm The H1B ”grace period” after a layoff is 60 days or the expiration date on the I-94, whichever is lower. If you are aware of, or suspect H1B fraud, use the ”USCIS Tip Form”.

H1B's are scam artist. If they get laid off, they never leave the US after 30 days after not finding a equivalent job. What they do is hire corrupt sleezy attorneys, who are usually foreign born to fabricate bogus paperwork stating they found a new job so do not need to leave the country, as they agreed to when they received their H1B visas. Total Scam.
ETW’s and H1B’s are NOT the same. A good way to describe an H1B worker is ”they are permanent staff members on a temporary visa”. A full-time H1B employee is entitled to receive the same benefits and working conditions as a similarly employed U.S. worker.
The initial LCA (Labor Condition Application) is typically approved for three years, and can be extended for an additional three years. Can an H1B be part of a layoff, of course…the likelihood…very unlikely. Because FTEs are expensive with benefits and it’s also expensive to get rid of them (severance).
Easier and less publicity cutting ETWs. And easier to scale and reduce your workforce with ETWs.

the world watched and some started their own impulsion and others just shook their heads are lost confidence in western culture
what we're seeing is the 'boots on the ground' effect of this culture shift, where it's somehow 'the right thing' or 'trendy' or whatever nonsense/meaning they tell themselves to justify it.
and by 'it' I mean, 'righting' the ship to be less american and more 'anything but american'
I don't know when it will stop, but this country is going through an identity crisis and I'm pretty sure the majority of citizens of this country are not ok with it
so it should turn around one day, hopefully soon, because I miss the old proud america and people that were actually proud to be american
