Client contacts me early this morning wondering what happened. He was told I left. He walked away from the conversation with the impression my departure was voluntary. Now he's pi---d he was mislead. Smh.

And BNY doesnt pay your attorney costs. It comes out of your settlement which is the income they owe you. And you pay all the taxes on the whole settlement - including what your attorney gets. Still it’s worth it to go after them.

They usually get a third if they take it. That way if you lose you have zero out of pocket. They are taking the risk. You can try and say it is 1/3 over anything that was initially offered by BNY but they might not bite on that.

Does 40% of amount recovered seem fair, as quoted from attorney? It’s confusing if they ask for legal fees in settlement.

Good. All clients needs to know what this shot hole is doing. Not just to it’s employees but to it’s clients accounts behind the scenes. Dinosaur systems, short staffing, offshoring to the incompetent. You name it and its happening. They deserve the sh-t reputation.
