Employees don’t get the September vest?

if you get your access cut ("gardening leave") before vesting date (September 15th usually), you don't get it, regardless the fact you may be still on the payroll.

@f8 September vesting RSU's haven't been clawed back yet. The language in the RSU agreements regarding "garden leave" does say you will lose them, unfortunately.

Sadly, I think you are correct. Separation and ceasing to provide services seem like two different concepts. At least you can take comfort in the huge jump the 1/4 distribution gave you, if you still held the shares.

@e7 I got my notice last week and was told I am an employee until Sept 22 with full pay & benefits (but no responsibilities and no access) until then, at which time I am officially separated. I haven't gotten my separation packet yet, that will get emailed on Sept 22 according to the FAQ they emailed me.

On p 16, it says "As of the date you cease to provide services to Oracle... all unvested Restricted Stock Units (RSUs) granted to you under all Oracle Corporation Stock Plans and all unvested RSUs assumed by Oracle will cease vesting and will cancel in accordance with the terms of the applicable Stock Plan and the underlying agreements"

I'm going to have to talk to a lawyer, but it sounds like they are sc--wing me out of this year's RSUs, clawing back 3/4 of the RSUs given in lieu of a raise two years ago.

@av So will Oct 5th stock vests be paid out to anyone laid off in September? Remember reading RSUs aren’t given during garden leave.

@e7 This time the dejobbed in the US were not immediately terminated, Some remain on the payroll with full benefits until late September or beyond.

how do you know they are kept on the books? cannot they just lay you off effective immediately with severance substituting early warning required by law? I checked my country labor laws - it explicitly allows substitution of early warning with payment for equivalent time period.

that's the whole point, to claw back those RSUs
that's the main reason why top performers got laid off prior slackers, (((accounting)))

@OP yes, if you get laid off and if your last day at work is before the vesting date or release date of your stocks, you won't get it.
