Companies pay a 10.5% tax rate when they offshore work. That's half of what they pay onshore. The H1B fee will only further encourage offshoring jobs and work. The reality is, the US government rewards companies who offshore work.
This is a warning to corporations abusing H1b. It also traps H1b holders. H1b holders must stay with the current sponsor; if an H1b goes to a new sponsor, the new sponsor is subject to the fee. In addition to the plan, a 25% tax on foreign labor could be instituted. If you would like to know the administrations game plan, read up on the Heritage Foundations plans. GOP is able to enact change through policy. I'm sure the Board and ELT are scratching their heads. This is just another ELT blunder in workforce planning. Does this company have any type of business strategy other than a fancy fluff power point? Is there anybody in charge of strategy?

Petitions have already been filed for up and coming layoffs, so it’s not going to matter.
It’s a temporary, one-time $100,000 fee for new H-1B petitions, in effect for 12 months unless extended.
Who it affects: The fee applies to all new H-1B visa petitions filed after September 21, 2025.
Who it doesn't affect: The fee does not apply to current H-1B holders, renewals, or those already traveling abroad.
@hj the 100k fee is paid yearly. There's no way to make this work unless you have one of those a.i. gurus that get paid 1 million a year or higher.

I think companies will stop doing H1bs...too much uncertainty. First, $100K is alot of money -- no way it is 'business as usual'... second, maybe today it is $100k, but tomorrow, who knows? Also agree with poster that this will speed up the offshoring.
Annual fee is one time and does not apply to current H1-Bs. Divide 100K by 6 years and that puts a 16K tax on an individual. Their wages are still under American workers, so companies will continue to hire and double down on offshore.
As for existing, they will be more coveted and will be preferred when the time comes to layoff.
As with most government decisions, this looks good for headlines, but does nothing to fix the problem.

Companies will pay the fee because they can make it up on the backs of the imported labor within a few years. If the fee was imposed every year, that might make a difference, but I don't think that is how it will work.
Agree. It looks like @op has the effect backwards. If this goes through, there’d less incentive to have H1B employees here onshore. Might lead to moving more work to our offshore divisions. This could have the exact reverse effect of increasing RIFs.
I’ve got to hang on just a few more years until ready for retirement. Sure has changed since I started 10+ years ago.
Not sure how this would change ELV direction in offshoring considering the fee is for those seeking an H1B to come to the states? Maybe I’m reading this wrong.
