If you have been RIFs or fired, you can file a complaint with the EEOC. Based on what I have seen and experienced at this company regarding targeting age, race and s-x with RIFs, you may have a good case. https://www.eeoc.gov/filing-charge-discrimination

@cz please elaborate on the "upped game on documentation of RIF selection process to avoid getting sued." What do they do differently to protect the company that they didn't do before?
I was laid off in 2025. Out of about 7 in my group, I was the second youngest. They made sure to give me a list of the ages of those with same or similar titles.
In order to get compensation, you basically say you won't sue and you accept the terms. otherwise you do not get Sub pay.
That may be happening, but it’s extremely hard to prove. I know for a fact HR has upped their game on documentation of RIF selection process to avoid getting sued.
Accepting severance does not give the company a free pass. If you file a complaint the EEOC has to follow up and if they find laws have been violated, they will fine and or bring the company to court. As a result of this, any agreements between the company and the employee will not stand.
Good luck with that. If you took severance you’re wasting your time.
