In Spain, a company can file multiple layoff plans (EREs) in the same year, as there is no limit to the number of times they can be initiated. However, each new ERE must be justified by new economic, technical, organizational, or production reasons, which will be evaluated by the labor authority.
There is no legal waiting period between two EREs, but dismissals are collective if they affect a number of employees within a 90-day period, which requires the initiation of the procedure. Companies that lay off 50 or more employees must notify the labor authority at least six months in advance.
During 2025, Oracle laid off a total of 22 people back in February.
So, 8 months have already passed since the last layoff in Spain.
They can start an ERE anytime in Spain.
No need to wait or compensate anyone.

In Spain they cannot lay off people with a RIF or ERE until CY26.
If they do, they will be forced to compensate the rest of workers fired in the latest months. So there is no risk for now.

Not true! In the EU mandatory warning periods CANNOT be covered by pay. They can, and do, put you in a gardening leave but they cannot summarily fire you from one day to the next like in the US. The difference is massive, as here they are legally obliged to keep you as an employee with full pay and benefits during such notification period.

@cj In Czechia, they must report mass layoffs to the regional labor bureau and inform trade union representatives about layoffs and this report. If trade union is not present, they must inform all employees that might be affected by RIF.
If a company does not comply with their duties towards the labor bureau, all layoffs will come in force at earliest 30 days after proper report to the labor bureau (§63 labor law).

@cd if an ERE is taking place the last week of October in Spain , when are you guys Work of Council sending the coms to all employees?
@c3 maybe d-mb question but don’t they still need to notify Czech labour office after the EWC meeting, meaning the layoffs would realistically be end of November considering the mandatory 30 day period?

Confirmed end of October there will be a ERE in Spain
A meeting of the European Works Council is scheduled to take place in the Czech Republic next week. Layoffs are likely to follow the week after.

All we know is that there will be another round of mass layoffs in feb for every country….
