Notice Period

I am not able to get it from the HR site. Eliza is also not helpful in this aspect or I am no good in using Eliza - who knows

Waiting for the 401k matching credit (or should I) and the bonus check. Foregoing the RSUs

Questions are

  1. What is the notice period for SVP level employee?
  2. This year we have 25 days vacation - can these days be used during the notice period - including other time off benefits like Work from Anywhere, paid Safe time and other - are they prorated
  3. How does benefit work during the notice period -
  4. Am I still an employee (and rules bound) or can I be employed elsewhere in parallel
  5. Most importantly, how does compliance work in terms of trading - they can no longer terminate me ... This I wont HR will answer or Eliza can interpret
  6. Since I am leaving voluntarily how does the NDA and IP impact me during notice period and AFTER that (most importantly)

You can only take vacation days that you earned as of now. You accrue earned bi weekly. If you take more then leave, they will dock your last check. You may even owe. 60 days notice to not have to pay back your last bonus if you are higher than a job grade K. IJK is 30 days.

I would suggest you check your employment contract. I believe mine has explicit restrictions on being employed in other financial services. Will BNY find out? Probably not? If they find out that you are dual employed? Can they sue the cr-p out of you? Absolutely.

Check with a lawyer that's my 2cent if you do intend on being double employed for some time period.

The imbeciles running the place tried to tell me I was unable to take my vacation I had accrued once I put in my notice.

It was absolutely ridiculous.

I still took it but just didn’t enter it to the system

You should use all your accrued vacation time asap. If you take off more time than accrued, they can claw that back so pay attention to the details. Sick leave works differently in each state, so check the specifics in the HR policy. Don't worry about going into the office as you will be out before they get around to doing the paperwork to terminate you for cause.

Just as an explanation (why I raised the parallel employment and IP) The other firm wants me to start. I do not want to lose the 401k match or end up my bonus being clawed back (I did get a good number and decent RSUs which I will lose). Specially making me pay back a month salary for lack of notice is one I want to avoid.

Trading was just a curiosity - can wait for another 30 days.

Promotion did not materialize - I got some BS excuses. And after the numbers got some cold shoulders. Work I have been doing is mine but also stuck in the IP realm. I may get some legal opinion on that anyway.

Basically, I want to shut down and do not even go to work. Even for coffee-badging. That is the reason I was looking into sick leave, WFA and other avenues to stay off commuting into.

I really, if push comes shove, do not care about losing 30 days of pay ((calendar or business). But I really do not want to give them back a single penny. Yep, that mad.

I took my unused vacation time during my notice period. The 30 days notice is ridiculous enough, I'm not losing time I earned on top of it.

They could either roll with it, or give me a hard time which would have resulted in my leaving immediately and not training anyone. The new job wanted me to start earlier anyway.

Don't care about not being eligible for rehire. I would never work there ever again and they closed all the locations near me!

Vacation can be used, but that depends on your manager's approval. Attendance doesn't matter anymore so there is no point to work from anywhere. Safe/paid time doesn't get paid out so why are you asking about proration? Vacation doesn't pay out unless you live in one of those special states.

You are still employed and will receive full benefits until termination date.

You are still an employee bound to the contract. If you breach trading restrictions rules, what will you do given they cannot 'fire you', you should consult a lawyer on this if you really want to try. There are FINRA and SEC rules you might violate even if you choose to ignore BNY rules.

OP, its really 2 weeks notice is all you need. But one month covers any of the HR gimmicks.

Im also not familiar with any NDA or detail they may have had my admins sign . NDA for what? To not tell what they did to get staff here. I didnt sign it and have all the backup i need to hand over to get them sued

You can use any time during the notice period. Its pretty much BAU. This is just a heads up period to give people a chance to look for other employment cause they dont plan to keep you. Heres an fyi since im dealing with this for two staff right now. This company is trash. They are sending mgmt emails saying fyi your exception request is denied. Choosing to have staff work during that was an option not an exception. So now im getting talking points to terminate next week. I have no details on what those are in terms of end date , medical or anythjng.
