Curious to know what other people got in the past, if they negotiated, and how that process went.

@1wt since there are no unions at CDW, there is no NLRB jurisdiction over the employment relationship. NDA are quite common as consideration for severance payments, which the employer is not required to make in an employment at will relationship. CDW doesn’t give severance because they’re kind hearted organization. CDW give severance to get around the 60 day notice requirement for layoffs required by the department of labor. Essentially, the 60 days of severance pay is the notice this keeps CDW layoffs largely under the radar.
It is illegal to ask employees to sign NDA to get severance. https://www.cnn.com/2023/02/22/success/severance-agreements-rule-change-from-nlrb/
It does not matter much. It is a fraction of what you actually deserve. And they want to push non disclosure. If different numbers are offered to different people they might know you squealed. Be careful everyone. Nothing is beneath CDW.
Two months pay, three months health insurance
Not enough! Most shocking was the way that profit sharing was snatched back. And they pay the severance in a single lump sum, you get taxes withheld at the highest possible rate.
I wish I had talked to a lawyer
You don’t have to sign the NDA even if they pressure you to do it. And even if you do, you can still go to a lawyer. It is wrong to put people under pressure after the shock of a layoff. The pressure to sign by a certain date is the giveaway. But even if you sign you can still go to a lawyer they just want you to feel like you cannot.
I advise talking to a lawyer if you are aged 40+ because over 95% of those laid off have been 40+ - and their jobs get renamed and filled by people making tens of thousands of dollars less. There has been blatant age discrimination in these layoffs.
They make you sign an NDA about it.
