There must be serious violations of laws involving the H1B Visa abuse that takes place with Fidelity. They also practice segregation by keeping these H1B Visas away from all the non H1B Visa employees. It never felt good, it always felt illegal. There's obviously only 1 reason why they would do this, and it's obviously not talent / qualifications. It's all about the Benjamins. Does anyone know how to file complaints about these obvious violations? I am afraid to speak up at work, because I don't want Fidelity to Retaliate against me. Retaliation is unfortunately a serious concern.

Ive seen printed job reqs hidden in obscure areas of the building like low foot traffic dead-end hallways so they satisfy whatever “publicly posted” law for H1B roles. There is CLEARLY an attempt to hide these roles as the hiring manager already has their handpicked candidate and yep 10/10 times its for an engineering role.
@d8 enlighten us and explain couple of violations. If you are that savvy and smart you wouldn't be asking your original question in the layoff forum to begin with, get a life and move on!
@ct I am the Op , my issue is American Jobs. Taking advantage of loopholes / corruption, broken system.
There are tons of qualified American people that can do the jobs in that area. But they don't get a chance because of loopholes which possibly involve lying and cheating to obtain human labor at discount prices. This is most obvious. There are absolutely college kids who graduate with these skills, but it comes down to an issue of wages. Everyone deserves a fair living wage. But Fidelity most likely is violating obvious laws by taking advantage of loopholes.
There are websites and companies that specialize in getting H1B visa workers into America to take away American jobs. It is absolutely not a lack of qualified individuals. There really should be more reports of these labor violations / abuses

@ca yes. tech is 80% Indian born, but only 10-15% h1b dependent because the other 60% have completed the process.
Tech is absolutely 80%+ Indian born here. I imagine they can use call center/finance people to defray that and keep the company as a whole below the "h1b dependent" threshold.
They're not cheaper or more hardworking. They just only hire or promote their own.
The perception 80% of tech is h1b is incorrect. There is 10-15% threshold of h1b that is carefully obeyed. As soon as someone gets through the h1b process they are not counting them anymore. They show up in the eligible to work without sponsorship classification.
The reporting should address the pathway and country of birth to see true numbers
FYI - This falls under whistleblower protection laws. Might be eligible for a Reward depending on the size of the abuse.
Retaliation is illegal. Employers cannot fire, demote, or discriminate against you (U.S. worker or H-1B holder) for reporting in good faith.

I I still don't understand why H-1B and green card holders are given managerial positions. These visas are meant for technical work, not for supervisory or executive oversight. Granting them these roles seems like a serious violation of immigration regulations.
