Thread regarding Oracle Corp. layoffs

WARN not applied

Only got 10 days of notice period. Remote worker from Nevada. I'm seeing others have gotten 60 days. How does it work?

@ap weren’t you asked to provide a personal email as part of the self-service layoff?

Single day notice, notified today, last day of work today. The WARN act is not cut and dry for remote workers like some are saying here, just because a company is a fortune500 doesn’t mean they don’t get sued and have to pay out for wrongdoings ALL the time. We’re going to have to turn to legal regarding notice, severance and proving potential contract breach/wrongful termination regarding vested stocks. I’m 3 months away from my final vestment, what about you?

@OP I was surprised by this too. Many would not have expected this. What's the strategy?

I am sure they checked WARN requirements and did it just in time to avoid paying employees vested stocks

@ap It will be sent to your home email. IIRC you have 30 days to sign it.

If you've had a short tenure at O, it might be worth trying the lawsuit path as the most you will lose is a few weeks of severance. But if you have say 26 weeks of pay coming, it won't be so easy.

If you are (or were) WFH, WARN does not apply to you. (Not unless you have several coworkers as roommates in your house.)

I've enquired about this to Hr, meantime not signing the docusign. Does it have a deadline? also when oracle email is cutoff how would we access it?

@aa WARN triggers based on the number of layoffs at a single location and doesn’t apply to remote workers. Another reason why Oracle was so keen to make people remote.

@OP
Oracle is a professional layoff machine. No idea why anyone here thinks they are smarter or know the rules better. You've been laid off once, they have laid off hundreds of thousands.

@aa I’m still awaiting a reply from HR, but I suspect they structured the layoff to fall below per-site requirements. I shared a link to WARN requirements below your response.

Oracle didn’t file WARN notices this time required by federal law. How can they avoid lawsuit?

Need class action lawsuit ASAP!

In contrast, Epic Games filed WARN notice for much smaller layoff in total numbers. Just a point of reference.

Update: I have not heard back, but I suspect they are basing it on “single site of work” as described in the document below. With 10k total layoffs, I suspect employees were selected to minimize the WARN impact. I do not see WARN notices for either of my states (home/office).

Same here. I reached out via the HR portal and will update when I hear back. I recommend not signing or even accepting anything until that is worked out.
