People being laid off in Freising. Are you negotiating or accepting the offer?
I got 2 months of severance, not enough to wait for unemployment benefits.
If we don't accept can they fire us?

I heard from many affected people that they mainly targeted the foreigners for layoffs as maybe they don’t know their rights…

Getting a lawyer’s help is my only recommendation. It is a stressful situation to be in, and although legal fees might be expensive, it is a good support when you are in such situation. Especially if you are a foreigner or are not familiar with German labour law and your rights.

@bc talked to the Arbeitsagentur and Betriebsrat, both told me not to sign. We can't be fired without a cause that easily and compensation would be better than the current offer.
The Arbeitsagentur told me that if we voluntarily resign we'd have to wait for 3 months for unemployment PLUS 1/3 of the severance would be taken towards that.

@c6 betriebsrat is pretty weak. You won’t receive any help from them. If the decision is made to terminate you then work with lawyer and negotiate the best severance.

@bc there is nothing you can file right now because you only received a voluntary offer.

In case you are considering the offer, you should talk it through with a lawyer and maybe also talk to the Betriebsrat

For now, this is only an offer and not accepting it will not result in a termination. If not enough people accept the offer, TI could
1) extend the offer to more employees until enough people have accepted
2) if they want to terminate people, they have work out a social plan with the Betriebsrat (it is basically a ranking of time of employment, age, number of kids and other factors that is used to determine whom to lay-off)

From which department they are laying off the people? Engineering or non technical departments?

Get a lawyer immediately and file an emergency injunction - the minimum it will do for you is delaying the whole process by months and potentially getting a better offer. Some people in the past where even able to avoid getting laid off altogether as the next upturn was there by the time they had exhausted legal options.
