Short term leave

My doctor believes I should take short-term leave; and I’m wondering if a person is on short-term leave can they be fired or laid off during that time.?

@kh that may be very true, but consider the fact that there are some top-performing people who are not here — and we’re fired, so there is no rhyme or reason …. it’s just the luck of the draw. I count my blessings every day that somebody is looking out for me… Not sure who but obviously is, which gives me hope that maybe there is some decency left in the world

@d7 what I don’t understand is if a person has a medical condition that requires them to be on leave, why should a company take that as something that something terrible that the employee is doing. For example, what if they have to get their leg amputated… should that be held against them?

@ek so I filed for short-term leave on the advice of my doctor – – actually two doctors; and I had received two inconsistent meets in my last two year end evaluations even though it can be argued that that second inconsistent meat should’ve been a meat. In other words, my manager wanted to give me a meet, but his manager forced him to give me the latter IM. There had been talk about how I was being targeted, but nothing was really done. So should I withdraw my short-term medical leave claim even though things don’t look good; but it sounds like because of those two items I could be fired really not sure what to do… All I know is that I did rely upon my doctors advice and here we are.

If there are any review periods while you are out on leave you will get rated IM or Not Meets so they can get rid of you when you return from leave.

@d9 this is 100%. The remaining team has figured out how to work without you for a few months. They aren't allowed to backfill because you are technically still on the team. Then, they'll review that they don't need the role any longer.

If you aren't there because you're out on leave and nobody really even notices you are gone you'll find yourself on the next layoff list, so if you absolutely need to take a leave you better be doing some irreplaceable level of work.

Yes, you can be laid off while on leave, but they will wait for you to return to start the layoff. You can also be terminated for cause while on leave, but that’s harder. Say you committed sales misconduct and they determine you did this while on leave. In that instance, they can terminate you even while on leave.

If the role is eliminated, it doesn't matter of you are on leave or actively employed.

You definitely can be laid off because is the role is being terminated. They would usually wait until you get back from leave though.

Doubt you'd actually be terminated for cause though.
