Just wanting to keep this post active. Make sure that you review your severance document with a lawyer before signing it.
Just heard a story, the company also offered 1 month/ year when separating someone that got involved in irregularity (ended up separated without a cause despite violating company policy because the company doesn't want to litigate/risking the policy got scrutinized).
15 weeks for 5 years of experience (3 weeks per year of service). This is the standard they offered in 2020 during the Canada Study, but for a company that "doesn't do layoffs"....
@f9 Because the under performer is a risk to potentially claiming discrimination or wrongful termination.
Everyone getting laid off together is less of a legal risk.
So an underperformer being separated just last month got 1 month per year while I am being offered 3 weeks, potentially 2.5 weeks if taking benefits (pension+saving) into consideration. f*** this POS of company

You should be getting at least 3 weeks per year of service at the company.
Severance estimate at just over $110K for 19 years of service… I guess everyone is going to get sc--wed until the very end. If these were done by the EM team in Argentina, then I’m not surprised as they always mess up our Payroll anyway.
I read that in court cases severance calculations typically were based on total compensation (salary+benefits). If we add our base plus pension and saving account, that should add approximately 20% to our total compensation. Based on this my number is closer to 2.6-2.7 weeks per year of service. It's really on the lower end.
@bd not good old days, I was asking about the people who just let go last month. Seems like you are not very well informed.
@b9 probably because it's already maxed out for you. EI and CPP are capped at certain amounts, can check on CRA for the latest numbers (adjusted by inflation every year)
@as Also, IOL isn’t magically going to increase their costs by 20 % just because everyone thinks they’re entitled to a month per year because of a buddy who got canned in the good old days.
Some people in unique situations can probably get more, but as you say - juice has to be worth the squeeze of legal fees.

Only income tax was deducted from monthly severance. Not cpp or ei.
@av you got a large severance almost half a million, how many weeks per year of service is it?
@b1 all normal deductions apply. Recall EI and CPP1/2 capped at certain amount. Those severed will have options get lump sum right away or defer to the following year (to minimize tax burden if you get severed towards the year end).
Is 3 weeks based on base salary only? Or 3 weeks based on bonus and RSU?
Any idea what all the deductions would be? Just federal tax? Or does ccp and ei come off too? Anything else?

Common law norms are capped at 24 months except for exceptional circumstances. Anyone offered less than 4 weeks per year could probably get there with a lawyer but make sure the juice is worth the squeeze (lawyer fees)

My severance is 3 wks per year of service, and I have less than 10 years with the company. I did some quick chapGPT, and it says common law might grant me 6-8 month based on my experience and weak labor market. Is this a good package? Should I find a lawyer to challenge it?

EM/USA people please withhold your comments, Canada has different labour law and our salary is only 60-70% comparable US positions.

Just don’t share exact numbers. Be pretty easy to narrow down who you are by the company if you had exact numbers.
And yes they will look at social media and internet boards in situations like this.

@OP I would personally advise against sharing any of this. Other estimates will mean nothing to your specific situation. I would however, advise to just spend a few hundred bucks and clear conflict with a lawyer. Have them review it if you feel you need the interpretation.
Still haven't received mine, HR said that communication is out starting today and trickles through the weekend. Meanwhile taking a crash course on employment law with the help of chatgpt.
