@c3 Does “cannot talk bad about the company” = do not tell the truth about the company culture? How they hire and promote?

@c3 Thats not entirely true, the FTC ruling has been challenged in courts and its very split by state if its being upheld or not. Most non-compete regulation happens at the state level, with significant variation. Again, it is likely that it will not hold up in court but it is still expensive to fight it so you need to know what you are signing and not just hope that no one will hold you to it... when I was layed off I got them to narrow the scope and reduce the time.
@ag Feds did away with the non competition there are rules in your Pepsi package. You can’t share any technology or ways of working for 3 years and you cannot talk bad about the company. You could work for coke tomorrow if you wanted but why would you.
@a4 same 2weeks per year this round also
I took VRP last year. It was 2 weeks for every year, capped at one year's severance. There is a 12-month non-compete, although, like @af+1kc4ankzj said, there's only a small chance they would pursue you unless you're actively working to bring down Pepsi.
@af As someone that has been threw it before, this is true BUT very dependent on location, make sure you know your laws and rights by state and you are still under contract for that long so, even though its unlikely they will come after you, they can... will they lose... probably... but do you have 5k sitting around for a lawyer?
Im just saying, make sure you understand what you are signing... they will craft it so that you read how much the total amount is first so that you sign quickly, just read and know EVERYTHING is negotiable.
@aa FYI non competes are entirely void if your new role makes less than 75k. Second, no judge is going to side with a corporation v.s. employee who was laid off against their own choice. Additionally they cant ban you from working in the same industry in general, and it only applies to exact roles (vp of marketing to vp of marketing). If the new role is at all different its basically void. You have to actively be leveraging competitor data or clients and then they have to use actual lawyers and money to battle you. I promise no one cares that much unless you happen to chop off the leg of a company in the process
Are they offering any bonus payout in addition to severance? What about accelerated RSU vesting?
@a6 biggest thing to lookout for is noncompete... sometimes they will give you 3 or 6 months severance but the noncompete will be for 12 or even 24 months.
@a6 give me a pen!
just remember - to obtain severance - you have to sign a lot of paperwork. its an insane amount of paperwork.
I’ve heard it’s typically two weeks for every year, but since I haven’t been impacted in this round I don’t know if anything changed.
