How to File a case against for Layoff a resident and holding a H-1B

What documents required:

  1. Employment records, Performance review
  2. Aria pages of you and H-1B reporting to same manager
    Evidence that you and H-1B candidate are in same or similar position
  3. Git commits screenshots showing you both worked on same code.
  4. Proof that the H-1B person is still in Job when you are laid off.

How to file a case :
You have to file a pre-compliant inquiry with your civil rights department

Under Federal law it is illegal to prefer foreign workers over U.S. citizens based purely on citizenship status (like visa) if both are able to perform same duties.

Layoffs are not based on performance. That has already been established. This tech and the business was built here, at a time when H1B did not exist.

lmao. I am on h1b. but this is really hillarous. layoffs based on performance. lets give an example. Employee 1 starts his day at 8 am in the morning. do some bs, for next 4 hours , solve some easy tickets, the complex ones sev 1s , just collect data. then lunch hours. then after 2 hours its almost hand off time , any sev1 auto transfer to next shift. here comes the h1b ahole at 12pm , customers are alteady escalation, management under pressure, and then he goes to call, understand the issue , review the problem and resolve the issue after working for hours. this is happening every day. every single day. keep taking screenshots for evry thing u do or dont. At the end of the day , job stays with the person who actually get sh-t done. you might win some settlement money , might not , cause courts cant always quality check work , but u will never get a job again. at the end of the day you did not learn anything by not actually working. super easy for an h1 to find job anywhere any company in the world , at least for me. byee!!!
