Has anyone had any luck negotiating their severance offer? If so how did you go about it?

@OP I doubt you will change anything. If they bend for you, they would have to bend for everyone on short/long term disability, and anyone who had an upcoming surgery for which they had already initiated short/long term disability process. Highly unlikely. It's a rabbit hole, so you could end up spending a lot in legal bills. Severance offered may have to be good enough, unfortunately.

CVS and Aetna back you into a corner with these agreements. They make you sign a waiver of rights to sue or go to EEOC with legitimate complaints. Severance is not really good faith as they say it is. Its used to buy your silence.

Definitely contact an attorney to see if there are any laws that protect people from being laid off right before their maternity leave. That's pretty cr-ppy since they already knew you were going to be out. In their eyes, you were probably the easiest target since you were going to be gone for a while anyway, unless your whole department was being eliminated? Terrible.

@dt The time to speak up about kickbacks was prior to you being laid off. There are specific laws for fraud and abuse as well as the Anti Kickback Statue and False Claim Act.
I think everybody needs to step back and if they see something they need to do something about it. I realize that everybody has families, and it can be daunting and intimidating to speak the truth. However, there is some protection out there if following the proper channels of how to speak up and to who to speak up to, to report it.

Not with CVS, but with another company. I outlined why the situation needed to be reviewed by the legal team given the extenuating circumstances. I listed my blue sky wants. In the end the offer was between the original offer and my proposal, which was what was needed to get by. It doesn’t hurt to ask. Good luck!

Some of us have family to support and sign severance which include not saying anything negative even if we know about nepotism, kickbacks, showing up to the job drunk. ageism,....and that's one department, let alone the whole company.

Oh...hmmm... did they know you were pregnant?

By being laid off you lose FMLA and would not be eligible for a year someplace else.

In your case, I would contact an attorney.

There are people who were laid off for reasons that no one would dare put in writing, if you know what I mean.

Take what they offer and be glad you're gone! I was laid off last year and it was the best thing they they ever did for in in 35 years with them! Just GO!!!

No, but I’d imagine you’d need to have solid ground for a very expensive lawsuit that you’d likely win or inside knowledge only you have and would cripple the company if you left without passing it on for them to let you finish asking the question, let alone have the conversation.

Otherwise, they’re letting you go, what possible incentive would they have to offer you more than what they’re giving anyone else?
