How does one negotiate a better severance package? You've been terminated, what leverage do you have to negotiate, especially when severance is not even required by law? I've been laid off from other places and the severance offers were always "take it or leave it" and required signing away any right to sue for wrongful termination.
Heck, it's tough to negotiate when receiving a job offer. Unless they really, really need you the offer will also be "take it or leave it". If you reject it then they will make an offer to the #2 candidate. I have seen this from the hiring side. We'd pick someone and they rejected the offer. We just moved on. If the #2 candidate was acceptable an offer would be extended, if not we interviewed more candidates. And this was not at O.
@1d3 no, I got rsu’s offered as part of job offer.
@17r read what was written. The performance metric doesn't apply to the vesting. You got RSUs offered to you because of PAST performance.
@15x That is not necessarily true. Not all Rsu’s are tied to a performance metric. Mine were not, other than being an employee for the duration.
@141 so what, it is another effort that will fail. You can sign petitions all day long but it still isn't going to change anything. The question isn't whether they gave employees enough severance. The answer to that will always be no if you ask the people laid off. The question that will make a difference is: "Did they pay enough severance to meet the requirements of existing laws?" The answer to this is yes they did meet the requirements of the existing laws. You have not legal complaint so move on. Sorry, life is just not fair... it really isn't.
@s9, RSUs are actually future compensation that you become eligible for based past performance. If you meet the requirements established when the RSU were granted than you get the shares when they vest. Not working for the company for the time duration required is grounds for terminating the grant. It was covered in the legal documents you agreed to when you accepted the grants.

Comparative backward negotiations was d-mb a%% stupid tactic that never works. I’m surprised a legal firm would make such a stupid argument in right to work states. They should have focused RSU as part of the annual EARNED performance reward and forced labor. Withholding earned compensation is forced labor and banned by most countries.
@fg Aren't "other tech companies" also building datacenters?
Oracld real cashflow is in negative due to massive debts for OpenAi. Oracle cannot offer cash handouts like other Tech companies.
@ae I wish the article pointed that out that anomoly. It's weird for the company to get press that it is perusing new initiatives that cost quite a bit of money.. but yet they're strapped for cash so they have to gut talent and existing business support/work.
Is this really a surprise or news? The other companies referenced in the article have very different financial situations. They can afford to offer better packages. In Microsoft's case they are granting golden parachutes for long term employees who retire. The next round at MSFT won't be so friendly and it is coming.
