Bogus Performance Reviews

Everyone knows they are making up bogus performance reviews and attempting to fire people with little to no severance based on said bogus reviews. I no longer work there but still in close contact with many. I was told by legal counsel the made up bogus reviews themselves while beyond unethical, not technically illegal. I would be curious if anyone else has had success legally fighting them on that basis alone? Outside of my curiosity, any information may help others. I went after them based on protected class issues that are illegal - discrimination, retaliation, etc. That worked. They wrote me a check for a year within 2 months. They caved easily. No effective internal counsel whatsoever. They were all fired too so they farm out to junior staff at Reed Smith. The whole thing is disgusting but nothing we can do to change it other than keeping one another informed. Maybe will change someday when legal action is so frequent becomes untenable for them but don’t hold your breath for now. To all of my friends, former colleagues, and to those of you I don’t know who still work there, I sincerely wish you all the best.

@1kq your comment is spot on age discrimination, why can't they continue to work if like too?? Maney of our colleagues are being terminated fired instead of layed off/RIF, 25 years of thriving performance here making bony a success and it appears due to age they are being rated below unfairly, and we all know why

@dx if you’ve been working at a company for 25 years and you still have to work to support yourself and your family, you messed up along the way. Do some inner reflection instead of a bogus excuse.

@149 They only disclose dates of employment and position. It is automated through myworknumber. Your FINRA U-5 will show reason for separation.

Question for anyone who has (or had) a FINRA securities license and went through this BS fired for a bogus performance review. What's on your U5 as it relates to your separation? Also, has anyone negotiated what the company can or cannot say during verification of employment responses?

Questions please.. how long did this take you from the say you got sent packing by HR to getting your money? Was this your attorney just going HAM on BNY to give you full
Severance pay or was there a lawsuit filed which resulted in a settlement? Did you get your full term of severance of 2 weeks per year? Much did your attorney take of the amount? Did BNY make you sign a release saying you cant sue them or ever work here again? LOL , as if you’d want to do that !

@m7 I didn’t like my chances going it alone so my approach was to interview 3 labor attorneys and hired the one I felt most competent. It worked. I could be wrong but I highly doubt could have done it alone. Attorney was all over them and they caved quickly. Some attorneys work on contingency, others by the hour, and some will give you the option if you want to pay hourly or contingency. Once you sign the BNY release you give up recourse so is important to not sign and act quickly. I did sign release after they agreed in writing to pay me that much and attorney advised me was a fair deal. I do not want to give up my identity so won’t mention location or precise law firm. I’d imagine you would be successful with a similar approach. Best of luck to you and everyone else dealing with this nonsense. For the record, I am also the author of the ‘Fight Them’ post people are referencing. I’m not venting or disgruntled rather trying to help others navigate. I had a long great career with this company. The issue is obviously current leadership/ soft Goldman takeover. It will get better someday I’d imagine but not anytime soon.

OP here again. I would like to add, I did not need to file with EEOC or anyone else. The threat of me doing so caused them to cave easily and pay a settlement within 2 months. I would have done so and pushed as far and as long as needed if necessary but it wasn’t. I am interested to see what will happen with the referenced lawsuit on bogus performance. I have not heard of anyone winning on that alone yet. As mentioned, I was advised that was not technically illegal but would look bad for them if actually litigated. My success with them came from a ‘protected class’ strategy. Again - I’ll remind everyone they have no effective internal counsel.

You generally have 180 calendar days from the date of the discriminatory act to file with the EEOC.

300 days (most common)
You have 300 calendar days if:
• Your state or local government has a Fair Employment Practices Agency (FEPA), and
• That agency enforces a law covering the same type of discrimination.

Is there a deadline to file with EEOC? I was told yesterday that I won't get my official letter until mid-January, which makes me wonder if that's done intentionally to play with the time-line you have in order to file a claim.

I was let go forced out in October. Filed with EEOC but had to schedule a meeting online and it’s all the way out to April! How can we get this escalated. I know at least 6 people who they did this too!

You can turn it in to your states EEOC. As a mgr i can 💯 confirm they forced ratings and changed them after we entered them to hit their reduction %. People have challenged this and the attempt to not give severance and noted on this site they have won. Others noted journalists or lawyers looking into this and wanting details.
