Thread regarding Bank of New York Mellon Corp. layoffs

How is this permitted?

I havent been laid off yet but was told to start looking cause I probably wont make it next time. Also after decades of service I was rate does not meet expectations. NO warning or anything. Told they were forced to do this because I am in the least important position in my unit. How is this permitted.

This is similar to my scenario. False statements in my performance review. Has not been a pleasant work environment. Many of my colleagues have already been looking for other jobs. I’m fortunate to have been selected so I can receive the SUB pay and get out of there. I realize others may not feel the same way but for me it works. Good luck to all those impacted.

How is it not permitted? Did we repeal Lincoln's amendments on lifetime indentured servitude? Was slavery not repealed? Pretty sure the Civil War ended that sort of relationship where Master and Servant were bonded for life.

I dont feel I’m the least valuable. I am in the lowest grade of everyone in my unit and I am an assistant. I just feel that saying that since my position is the least important and if they get called to lay off someone it will be me so that’s why I am rated as does not meet expectations. Nothing negative was said at my last evaluation at all. I was shocked. We have one that reads a book at least half the day another who runs around all day never in her office and is mostly good at watching what everyone else is doing and another who does whatever they wants gets in everyone’s business talks openly about everyone especially when they aren’t around. I don’t think I’m less valuable. I was told to look within the company but who will hire me now with this rating.

companies in Pittsburgh have been doing this for years, dumping older employees because of their higher costs, salaries, health care etc. someday one of the local law firms is going to figure out that even if the laid off employees signed a wavier, it does protect the company breaking the law. their will be a major class action suit.

Meanings have changed. Managers rank by those they perceive make the cut, and those that don't, get severed. Crying about it won't change a thing.

It's left to each direct manager to determine who falls below expectations, and the curve demands that someone does. For all the complaining around here, the only material issue was did your boss feel like you were the last valuable member among her reports?

Their doing it that way to prevent age discrimination lawsuits. The end data will show all age groups will have workers documented to be below expectations on performance reviews. Thus, their defense is that age had nothing to be with the termination of employees. However, the over age 45 group will in fact get hit the hardest. Statistically speaking, the older you are the percentage of "hits" to your specific age group will be higher. It's all about minimizing costs (i.e., lawsuits) even if they have to falsify employee performance documents. Unfortunately, these documents will hold up in court. The company knows that the subjective nature of performance reviews gives them a license to "sell their soul to the devil" at will. They sleep at night by convincing themselves "it's just business".
