Overpaid after leaving

I left the company some time ago. I just got a letter stating they overpaid me after leaving. They are asking me to send the money back. Anyone else get a letter like this?

I had a similar thing happen to me. After leaving Honeywell, I continued to receive my regular paycheck. I notified HR, and they took care of the problem. About 2 months later, I received a letter in the mail stating that I needed to send them a check for the extra payment. I did some Google research and found that even though Honeywell made the mistake, they are entitled to re-payment. I ended up sending them a check.

IANAL, but If you decide not to pay, I believe they would have to take you to (small claims?) court to force you to pay. You will have to weigh the risk/reward for yourself. What are the additional costs (if any) of being taken to court vs what are the odds that Honeywell would send the lawyers after you.

If you do write them a check, pay close attention to your taxes & 401k contributions to make sure they performed the adjustments correctly.

My wife retired in 2014. She was over paid for 3 extra weeks of vacation. She noticed it right away and contacted her last HR person. After like 3 or 4 weeks of not hearing anything back (big surprise right? LOL) she contacted her last boss and finally in about 3 or 4 more weeks later HON sent thru a transaction thru her direct deposit to take back the $$$.

-shf: It's been since March 2017, but yes, I received a letter and a deposit to my checking account a week later for a change in my separation payment calculation. I was pleasantly surprised.

Yes, this seems to be a routine behavior where they can’t come to a final accounting when an employee leaves. Either they overpaid for sick time, relocation, ... not sure what it could be at this point in time as they do not pay for much of anything.

The interesting thing is that, they usually try to withdrawal from your checking account ( you gave them that permission when you signed up for direct deposit) first, then notify you.

I always advise my people that are separating from the company to get new bank accounts set up ( and move their funds to that account)so that when the inevitable overpayment is found HI cannot take back what is not there.

My experience had been that, for each employee separating (three in the past two years) HI sent a demand letter after they could not get the funds out of the bank.

So there is a little more prep work before to do before giving your termination notice.

But to your question, none of the people I have knowledgeable of paid any of the funds back.
