I am hearing rumors that SEC is investigating Oracles cloud biz. This comes as no surprise...

Anyone hearing the same? Please share what you know and what you experienced while employed at the company.

Funny enough, the execs’ own words onnearnigs calls may be the best evidence against them, including SC proclaiming that oracle cloud models was designed to generate 80% margins. Self incriminating since that is plain not possible if you actually run a real cloud business where you actually provide cloud services to customers, it plain requires too much investment and customer support to generate that kinda of margins.

You’re absolutely right about how they think.

That said, this is classic: Delusion comes before the fall. More powerful people have fallen before and the 3 stooges are no exception, although they clearly think they are. After all, most criminals think they will get away with their crimes, or they would’ve have committed them, Madoff included. Can’t wait!

You are irrelevant to the 3 stooges. You are no more than an insect to them. They believe that you cannot do anything to them in any way. They have the lawyers, they have arranged everything so that they will remain blameless no matter what.

@2Khvo - what are you talking about? Disclosure of what to whom? You can share any info you want with your attorney and law enforcement, incl. the SEC. If you talk to journalists do it anonymously/ off the record to save yourself grief from oracle. And you can disclose info in a lawsuit as needed.

I'm aware that the disclosure of the information could cause retaliatory action and retaliation that will be from Oracle side covered and backup by legal and code of conduct rules.

Anyone is aware of such cases ? not the Svetlana Blackburn case that been settled out of court.

Although the 3 stooges and their enablers in legal and accounting are the ones who concocted the cloud washing schemes, their legal defense strategy will always be to blame ‘rouge’ employees who ‘violated’ policies despite the 3 stooges best efforts to the contrary. Do not become a victim of these shenanigans. If you need to find an attorney to represent you in dealing with oracle legal, contact the Bar Association in your state, explain to them what you need help with, ask them for a list of attorneys who practice in this area of law. In fact, do it now rather than later do you have the names when you need them!

The agreement that you signed where you agree to cooperate with oracle’s legal and other investigations, does not and could not, as a matter of law and public policy, prohibit you from seeking independent legal counsel and representation. If any internal/ external oracle lawyer tells you otherwise bring them up for violation of the Code of Professional Conduct before the Disciplinary Committee of the Bar Association that they are licensed by - your attorney can help you With that too. Look out for your own best interest; oracle will not

Do NOT engage with oracle legal or their outside counsel on your own without your own legal counsel by your side - it would be suicide. Doesn’t matter if you did something wrong or not, you need to be represented by competent legal counsel looking after your and only your interests!!!!! Oracle internal and external lawyers are they concover the behind of the exec and the corporation and will be more than happy to Thorpe everybody else to the wolves if it helps them!!! Look out for yourself just like oracle looks out for its interests. Spend the money, do not skimp on legal representation.

Oracle becomes aware of a federal investigation, so they started to perform an independent investigation though experienced outside counsel so it may lend credibility to the

corporation’s position, assist in the development of facts needed for a defense, and function as a public relations response. While they tried to minimizes legal risk and protects confidentiality and privileged communications.

But as it done poorly, costly and disruptive by the negligent legal and compliance management so

now privileges may be inadvertently waived and there will be a PR backlash caused by leaks or assertions of whitewashing.

Same thing applies to HR. HR is not there to help you. HR is there to protect the company FROM you. I went to HR with issues and was attacked back.

If you need help with something going on in the company, always go outside and get a lawyer of your own to advise you.

Oracle’s attorneys work for oracle not for you. They are not your attorneys, nor do they have any obligation to you. None! Also, Oracle’s and your interest may not, and in fact most likely, are NOT the same. You MUST to hire your own attorney who will advise you what to do and who will also advise you on how to deal with oracle/ or deal with oracle themselves. Yep, it’s unfortunate because it will cost you money, but it sure beats getting in trouble for oracle’s sake. Remember, Oracle’S attorney work for and are paid to protect oracle’s interest. They have no obligations to you and quite frankly don’t give a S:t about you!!! Never forget that!!!

Did anyone received also an email from Oracle Global Compliance Counsel that request that in case you will be questioned or approached by the SEC authorities then to immediately contact him in order to get further instructions on how to cooperate and how to protect Oracle confidential and restricted information and what should never be shared ?

I wonder if it's allowed and what should I do ?

In order that you will not be the one who in the end will be accused of fraudulent, my advise is that you will add to the sales team approvals in the DAS as many VP and SVP levels that once investigation will be in process couldn't not say we did not know but we enjoyed the compensations.

You know how LE, MH and SC are going to play any investigation: we put all these compliance processes in place and if people booked sales that shouldn’t have been booked, we knew nothing anout it. With our heads way up in the cloud, surely you cannot expect us to know what’s going on?! So make sure you protect yourself!

In general, given all the underhanded crap that goes on at Oracle, it's a good idea to record everything you can. You can buy pocket digital recorders with microphones that are good enough that you can put them in your pocket and record an entire meeting. Look for the ones with microphones that can pick up someone speaking 40+ feet away.

Protect yourself. Not just for recording dishonest dealings that might be related to the SEC investigation, but for all things. There are a lot of dishonest people at Oracle.

You should gather evidence of this by recording meetings, one to one conversations or disciplinary hearings.

You should record any conversation to protect yourself in the future against any adverse action from Oracle. If you have been worried for some time about Oracle unlawful conduct, you may even have established a dossier of recordings which you intend to use to establish your wrongdoing and assist any future claim which you may make or protect you from a federal charges.

For those of you who were somehow involved in cloud deals that may be considered questionable, you do appreciate that your road to salvation lies in being able to provide law enforcement with useful information against higher ups, right? Preserve documents, emails, meeting notes, lists of who else participated on relevant calls/ in those meetings so there are other witnesses, etc.
