SEC should take a look at SC’s statements on earnings calls of 80% cloud margins and the financial models behind them, prima face evidence of cloud washing/ fraud right there.
An icicles change in hell that oracle will come clean on all the cloud washing they been doing. And whether the government fines them or not, the private litigation will destroy the 3 stooges and rightly so.
I just been interviewed by Oracle external law firm that conducts internal investigations with respect to the Foreign Corrupt Practices Act (FCPA), international anti-corruption and anti-bribery restrictions, fraud, kickbacks and accounting irregularities.
They told me that they represents Oracle in such matters before the United States Department of Justice (DOJ), the Securities and Exchange Commission (SEC), other federal and state agencies, and international regulatory bodies.
They are now leading some internal investigations in Latin America, throughout Western and Eastern Europe, Asia, Africa, and the Middle East.
The leading litigation practice lawyer told me that they been hired to structures commercial arrangements to protect against compliance risks to Oracle.
It will be difficult to them to defend Oracle in investigations of potential corruption and they are trying to convinced the top executives in Oracle on voluntary disclosures of the matters to the DOJ and the SEC so they can obtain a complete declination from the DOJ and the SEC related to all of the matters (no fines or penalties).
Anyone else been interview and briefed by external law firm ?
Next Q report will be fascinating. 4th q with NetSuite so no bump, audits much less effective on generating revenues, and the big question - how much cloud washing revenue with the 3 stooges contrive given the SEC’s investigation? Can’t wait to find out. Expect a bad cloud quartet, only question is how bad. Stooges will have to chose between disappointing the market or more potential legal exposure. No wonder SC sold stock last month
The SEC needs to go and interview customers who paid for the cloud credits to get the skinny on how they were induced to pay for something they’re not using. Hint: audits and an offer to buy cloud credits they would never use they couldn’t refuse, because the cost of the cloud credits is less than what oracle would otherwise demand based on the audit ‘findings’.
DD and her Compliance and legal organizations are now in "damage control" of several cases of employees that been reporting to the authorities on Oracle corrupted practices.
I know what you’re saying, but in all thruth, more like disorganized crime - total mess with easy to find evidence everywhere. Just correlate audits to new cloud ‘sales’ with low or no usage and bingo!

What is needed is some kind of class-action lawsuit. Lots of people who have been screwed over by devious managers, supported by other management and HR. Sabotaged, attacked, etc.

I did a google search for "Oracle SEC investigation" and the only thing I found was a 2012 article about a Foreign Corrupt Practices Act violation. Nothing about the alleged cloudwashing investion.
So relevant as this SEC investigation will shake the entire corporate and stock price.
The changes will cause reduction in force in so called Cloud LOB.

She's unloaded as many or more in January as she has the two other years in total.
Could be SC knows I'm right. Stock below $30 by the end of calendar year 2018.

Safra sale of her stock options is the red flag for SEC: she sets up the cloud washing machine, misrepresent the financial condition of oracle’s cloud offerings and sells the stock at a historically high price.
The SEC should talk to JO, she ran software sales before she left and must have somebbeans to spill on how the 3 stooges set up the cloud washing machine.
