How is BAC able to get away with hiring H1Bs as backfills for laid off workers

I worked in a minority American department, and it was only the Americans who resigned or were laid off. Those positions were immediately backfilled with cheaper H1B employees, even though the layoffs were misleadingly termed a reduction in force. The failed former President never cared about Americans losing their livelihoods to foreigners, only promising us a high deductible and unaffordable health insurance program as a consolation gift while the big banks paid Obama bribes through speaking fees.

4hbn, it is unlawful, but getting around that isn't a problem - lay the person off and create a different job type and fill it with 2 or more h1's from the foreign outsourcing company that will replace the single American for the same price - what a deal!!!

@4hbn Tata consulting has positions posted at the bank which pay $65K/yr for Work which usually commands $100k+. Don't be surprised if the signs start to disappear after this post.

Actually, it's unlawful to pay an H1B worker less than the "prevailing wage" or the wage that you would pay an American worker.

The issue is not competing with landed immigrants. H1B's, including in front office and front office facing roles, will take a lower compensation from BAC simply because they don't want to lose their sponsorship and BAC has filed for their immigration which they don't want to lose.

BAC has monetized immigration sponsorship at the expense of American workers.

The reason Americans will not stand for lower compensation to compete wit is because the better employees can get higher compensation at other firms that can't use H1Bs as readily. The Americans that get hurt are those who are less versatile and savvy in the labor marketplace.

1mgx, visa policy doesn't need to change in order to save jobs, many companies especially BOA have several locations over seas plus they can work from their homes, no need to travel to America. People are very naive to think foreigners need to be on American soil, this is modern technology not farm work.
