US Trustee objected to the exec (11 of them) bonus plan

3.7mill if company achieves 205$ mill adjusted EBITDA for fiscal Q2 and 3.0 if the company achieves 175mill of adjusted EBITDA. Also they said the bonus is for the execs' hard work in steering the company through the difficult Chapter 11 period. What a bullsh.t. They are already paid for doing their jobs and a sh--ty job they did bringing Avaya to the bring of death.

In acquiring the DIP financing, the plan put forward was with a forecast of adjusted EDITDA of 166mil. So only 4 mill more, they will get the minimum 3.0 mill bonus..

Now we know why they laid off all the folks before Q2 ends.

Hearing for the objection is March 30.

A basic tenet of business is that you are rewarded for success and punished for failure. It's basic economics. What we have here is an example of a backward company (and corrupt leaders) that does the exact opposite for their executives. Rather than lead by example, they attempt to justify their greed by claiming that they have to work harder now that they have driven the company to bankruptcy. Seriously? Their incompetence and greed is on full display in the courts. I hope the judge sustains the objection and denies them any type of bonus. Anything else would be a slap in the face of the loyal people who are sincerely trying to help Avaya succeed.

This should be posted in every website and every employee should be asking their manager to comment on this BS. Read the court documents, executives need more money because now they have to actually "speak to customers" and "discuss action items with partners". This is a bloody joke. Bet no one will ask CEO about this on the next wasted all hands call.

So 7 months prior to filing CH11, these arrogant, self important, losers awarded themselves $millions in bonuses. From the bkcy docs:

"The May 2016 retention bonuses totaled $11,700,000 and were payable

as follows: (i) CEO Kevin J Kennedy $6,900,000, (ii) COO James Chirico $2,000,000, (iii)

General Counsel Amy Fliegelman Olli $1,250,000 and (iv) CFO David Vellequette $1,550,000.

Id.at 5.02, Exhibit 10.5 (Kennedy Agreement); Exhibit 10.6 (Chirico Agreement)."

Does anyone else think this is absurd? They want bonuses now because they have to work harder -engaging customers, etc - to ensure that the business continues. What a joke. Following their logic, everyone here should be getting large bonuses as well because it's freaking hard to keep this company from falling into the abyss. I am appalled that these so-called leaders have crushed this company and now want more money to keep it running. It's a total disgrace and an insult to everyone working here. How anyone can respect and support these frauds is beyond me.

The same losers who had already gottenmillion of dollars of bonus last year prior to filing Chapter 11.

So they know what the numbers would likely be in 2nd quarter and set their own weak target so they can grab more cash for themselves while letting people so for a meager 4 weeks of salary.

What a pathetic human being. If the judge has any moral, he should deny the motion.

A few Avaya retirees have written in to the judge asking him to stay the objection also.

These losers all the do is hire a CRO to oversee the supposedly restructure plan which has so far nothing except the proposed sell of Networking for a pocket change amount of 100 million.

KK still stands as the most hated CEO in many poll.

Those losers shouldn't get a dime. So, they fire a bunch of people for underperforming on their jobs and pay these incompetent so-called leaders a huge bonus for destroying a company. Ironic, isn't it, that the "leaders" can fail so spectacularly and get bonuses, while people get fired because they're low performers. Hahahaha. The arrogance of these morons is astonishing. I would say that any random group of homeless drunks could have done a better job of running Avaya. It probably still would have failed, but are we really any better off now?
