Thread regarding Honeywell International Inc. layoffs

I have a pic of a chart showing catagorizing employees it was left in a dry erase board

This chart shows age and years employed then breaks them up into 4 groups.

One group is over 40 with more than 15 years with Hon. It goes from there,

center of chart depicts a desired amount of years and age.

Is this useful for an age discrimination suit? Just curious cause it doesn't mention lay off or termination.

And no I won't put on this site for the world to see.

A recent court decision may create a whole new ball game regarding age discrimination RIFs at Honeywell. People 40 and older are a protected class that cannot be discriminated against and no doubt Honeywell looks very closely at the distribution RIF ages as 39 and younger versus 40 and older. However, the 3rd Circuit Court of Appeals whose circuit includes New Jersey just ruled that the disparate RIF impact on age groups within the 40 and older set such as 50 and older in this case, or arguably 55 or 60 and older could be considered. In other words, just sacrificing people between 40 and 55 to make the numbers work out may not be legal in this circuit's areas. http://www.natlawreview.com/article/third-circuit-makes-it-easier-to-prove-adea-disparate-impact-claims-use-subgroups

Thanks for the inputs. I was hoping for some intelligent feed back but knew there would be the jerks too.

If I get severance (26 weeks) I think I'll let it go but this WFH thing forces me out with no severance, I'll go talk to someone.

Thanks to all and good luck making the right decisions for your personal situation

Of course it's valuable. Don't listen to these jerk company shills. Keep backup copies safe. They know they are breaking the law, they just count on percentages to beat the legal costs. "Keep it secret, keep it safe." Talk to a lawyer about it. It shows intent and awareness as to the extent people are being targeted because of age and earnings. That is EXACTLY what age discrimination is all about.

Engines endured a serious age discrimination suit after the recombination of the propulsion and APU product lines, and I ended up giving a deposition. Back in those days I was a manager, but that was then and this is now. Honeywell lost that one, and it's not clear that they learned anything from it, at least not yet.

As noted, you may not have anything useful, although your comment about "desired amount of years and age is intriguing. Simple categorization of employee characteristics is not illegal compared to later actions. The fact that RIF'ed employees get a detailed breakdown of RIF'ed characteristics makes me think that leadership is keeping a close on the legalities. AERO Engineering has a very lumpy distribution of ages due to demographics (Baby Boom) and cyclical hiring and layoffs over the last 40 years.

Some form of that chart has been around for quite a while. I remember first seeing it 2K, 2001 time frame when Aero Phx was doing some big RIFs.

Highly doubt would be on a white board if they were actually assessing age/tenure for reduction purposes. Nobody is that stupid. Oh, wait a minute..........

If it is real and actually says that then it could be used as evidence in an age discrimination suit. But the chart alone would not be enough evidence. You still would need to show harm to an individual caused by age discrimination.
