Can you collect unemployment in the state of Louisiana if severance was collected. Have not applied yet.

That's interesting, 9qwv. I'm starting to believe that things can go one way or another in Louisiana (or Texas for that matter). It's on a case by case basis depending on who reviews your application for benefits. The severance pay is obviously the sticking point, perhaps adding confusion to the matter. If you think you want to appeal the delay of 8 weeks in your particular case, do so. You have nothing to lose. I can only tell you that in my case back in mid 2015 in Houston, TX, I applied online for UI benefits on my first day off the payroll. I decided to answer "No" about the severance question. I put down that I was NOT receiving severance pay. In fact, at the time of applying for UI, I had not yet sent back my Release Waiver to Chevron for my 1 year severance pay. My UI benefits application flew through without any further questions or hitches. I collected my first UI payment the following Friday. My personal view was, I was unemployed, so PAY ME.

Fyi, I applied the first day I could after I was off the payroll for LA benefits and they just now reviewed my claim. They said I cannot reeve benefits until after August 13th because the severance I received counted as pay for the 8 weeks even though it is a lump sum. SO yes you can file day one but you cannot start receiving weekly benefits until after the # of weeks your severance was for runs out. It disqualifies you for those weeks.

Yes, I lived in Houston for a while, unfortunately. And I tried my best to like it. I love Tex-mex food, and they seem to have plenty of places to eat, albeit lousy chain restaurants, and ample shopping, but what big city doesn't? However the Ignorant driving, offensive people who think the world revolves around them and just some stupid way of going on that I can only attribute to the Hispanic influence in the area I just couldn't tolerate. And no Southern Hospitality to speak of like in Louisiana. No Southern hospitality or sense of family welcomeness in the entire state. Many Texans (not all) think that they are better than everyone else just because they are from there and their state is the greatest in the union, it's common talk - Ask one!! . That's so pathetically egotistical, self-centered and ignorant. God I am SO happy to be away from that petulant cesspool of conceited idiots!!!

I tend to agree with 3nvz. However, my first Chevron job was in GOM and I rather thought it was very good. The company relocated me to Houston some 4 years before Hurricane Katrina changed the face of New Orleans and south Louisiana. I have some family still living there, so I have an occasion to travel to that area twice a year. I'm so happy to be have been living in Houston ever since my relocation. I'm even happier still, after Hurricane Katrina. Where once the area was tolerable, it no longer is. Chevron would have to triple my salary if they wanted me to move back to that hell hole. They would also have to guarantee me a relocation out of the area after working there. Don't get caught stranded in south Louisiana without a company paid relo package letter in your back pocket. That place has become the arm pit of the US to live in. Love the food, but hate the living there.

Have to agree with -1guh, NOLA is a disgusting area to live with awful people. Spent time all over and every time I entered the Baton Rouge, North Shore area returning to Covington that's when it hit the fan. Ignorant driving, offensive people who think the world revolves around them and just some stupid way of going on that I can only attribute to the french influence in the area. Many people have sworn never to work in GOM again and its different to all the other BU. If my first job with Chevron had been at GOM I would have never worked for CVX again. Thankfully, all the other areas are much better.

I used to live in Louisiana, now live in Texas. I filed for unemployment only twice in my life. First time in Louisiana when I was 19 years old. There were no online sites to signup back then. I had to line up at a local UI office and bring papers, fill out forms, watch a 10 minute video, sit down among with 10's of dozens of mainly low class unemployed people. It was so humiliating that I never forgot the experience. The second time I applied for UI benefits was here in Texas at age 58, after Chevron let me go. Here in Texas in April 2016, I'm grateful for having had an easy online application experience. Fast and easy. I signed up the first day my a$$ was off the payroll. Why the first day? Because I knew they would ask if I had received any severance. I had not and was expecting to send back my signed papers only after I applied for UI benefits. Sure enough, the TWC asked the question about whether I received a severance. My answer was "No". It was an honest answer, too, since I had not yet sent in my signed paperwork requesting it.

@1hzk, Point well taken, but we all know these government agency types are there to punch the clock and go home. They are up to their eyeballs in work in grunt work and don't have much time or incentive to dot their i's and cross their t's. Answer "No" to the severance question.

I had severance and also received the max UI benefits in LA. I have exhausted my benefits. I answered all of the questions honestly. Remember, they can easily access your pay through the IRS and correct a dispute. Don't try anything stupid like telling them that you did not receive severance when you did. Severance is severance. There is no such thing as a correct answer to receiving severance as "NO" when you in fact received a severance check. Also, if you wait til the week after you receive it, when you file your first weekly benefits, the answer to the question "did you receive any pay/compensation/wages/severance, etc" in the past week - for that week of benefits will be truthfully "no". They will request that you return the UI benefits and also most likely pay a penalty if you are what they called "overpaid". it happens quite frequently.

A copy of my severance/last paycheck/vacation paystub was required for the initial filing. I faxed it to them. At the time that was the quickest way to get them the info. That or snail mail. I also called them and complained when it was delayed due to the severance/vacation, etc. They may have given me a break by expediting it because it would have been a longer wait if they would have done the weeks severance/vacation math perfectly.

Lie to the representatives of the federal government at your own peril. I do not recommend it. You have a hell of a lot more to lose by getting in trouble with them or the IRS than that little piddly bit of UI benefits, believe me. They could make your life a living hell. They are waiting for the smallest little screw-up to deny you and make Unemployment look better for Obuma. They get all excited when those receiving benefits decline remember, Obama did a good job and you have no job. Seriously pathetic. In any event if your severance is that big, you probably are not hurting anyway and that little benefit is peanuts. There is a delay (min 2 weeks) in any case. Have some patience and call them. I friend of mine was denied for 6 months? because at once he told them he had a job lead he was following up on. BAM - denied. He had planned on continuing his filing, it was only a possible lead. BAM. denied. They are waiting for their chance to cut you. Thanks, Obuma, for perpetuating the myth that those receiving UI benefits or not is the indicator of a good economy, when this is going on.

I received my severance check from Chevron in Texas. I wasn't disqualified by TWC for that. I got my UI benefits without a hitch. I'm wondering if there could be hit and miss results for some applicants? If you are denied benefits for any reason, you need to appeal the decision asap. Good luck to all.

Dont waste your time I'n LA. I tried and was informed Chevron had already notified the State of my severance, my vacation pay, my lump sum and I was disqualified. Let me know if your results differ.

Read line # 7: You MUST tell us if you receive or expect to receive ANY money from your employer. This includes vacation or holiday pay, bonuses, severance pay, separation or dismissal pay, wages received in lieu of notice, tips, commissions, military retirement pay, workers’ compensation, WARN Act and any other payment based on your previous work. If you do not tell us about these payments, you could be disqualified for unemployment benefits and you will have to pay back any benefits you have received.

I would urge anyone in Louisiana facing a layoff from Chevron to get clear guidance from HR on how to best answer the question about severance on their UI questionnaire. In Texas, the TWC also asks the same question. In my case, I answered "No" to the severance question and nobody followed up or questioned anything more. Chevron HR assured everyone they wouldn't protest the application of any laid off employee. Chevron was true to their word. I received my unemployment benefits quickly and continually.

Your Weekly UI Benefit Amount in Texas is currently between $65 and $479 (minimum and maximum) depending on your past wages.

Your Weekly UI Benefit Amount in Louisiana is currently between $10 and $247 (minimum and maximum) depending on your past wages.

Practically everyone, even an Office Assistant, working for Chevron earns enough to get the maximum unemployment insurance benefit. What's really appalling is the startling difference in weekly benefit maximums between Texas and Louisiana. What a ripoff in Cajun Country!!!

@wol, I don't think you understand the "severance" rules clearly. Chevron's severance is different and will not affect you starting unemployment benefits from the first day after termination. Chevron's severance is a one-time payout for signing and returning a Release Waiver (a private agreement to not sue). This is different from other types of severance payments that other companies hand out "in lieu of wages". The latter form of payment disqualifies you from receiving benefits until the payments end. If you are still unemployed when those payments stop, you are free to file and receive State unemployment funds.

Technically you can't get payments until after th number of weeks of your severance are over. At least that's how it's been explained to me. So if yiu got 10 weeks of severance for example and your last day was June 13th, you can't start getting unemployment until August 22nd. If this is wrong though please correct me because I'd like to be collecting mine sooner rather than later.

Receiving the Chevron Severance will not stop you from being eligible to receive unemployment benefits in Louisiana. There are two types of "severance" payments. The single payment severance payout that Chevron is paying does not disqualify you. If the company instead, paid a weekly or bi-monthly payment over a period of time, you would not be able to derive unemployment benefits until after the periodic payments end. As far as I know, this is also the case in Texas, California and other states in which Chevron has employees.
