Do you think that we as employees who were let go in January have a chance to win a class action lawsuit against Target. I know that some jobs eliminated did not have a WARN notice, maybe that's something a good law firm would like to investigate? The whole thing with layoffs was managed so poorly from the communication standpoint and some iffy criteria when selecting folks was applied, I am sure we would have a shot. Target may end up with more than one class action lawsuit here, just saying. Thoughts?

Wait, what's the connection to asbestos, mesothelioma and lung cancer? I mean, how can you even compare this with layoffs? It's preposterous.
Im a past TM at Target and left on my own seeing the writing on the wall. I don't understand why you people think Target is doing something evil by cutting head count. Did they promise you a job for life? They have an impecable severage package and yet you are still complaining. I take back most of my complaints about Target now that I'm on the outside and have to be accountable for my time and work. I miss endless meetings, dog and pony shows and Seagull managers flying in a crapping all over the teams efforts and flying away.

You have an army of lawyers who just finished collecting millions on lawsuits targeting asbestos, mesothelioma and lung cancer victims - I guess it's time to move on and shred a leading corporation into pieces. It'll never happen, I do not think anyone has a case here, and even if they were to have a case how much can you collect because nobody informed you that you'll be let go. A thousand? Two? Come on...

I am not the OP but I think that practicing law can be done with different levels of aggressiveness - so, the fact that we have an army of lawyers really does not imply that we approached things in a conservative manner or in a way that would make courts happy.
Do you honestly think that with all of the lawyers here, they would do something that would open them up to lawsuit - like, oh, we forgot about WARN. Shoot. It is probably the reason why end dates for Canada were staggered.
Why a class action lawsuit? You may be better off doing it on your own and settling with the company. Your compensation would be exponentially larger, if you are contemplating it you may want to find a good labor law lawyer and see if they would want to represent you.

49 and #52 -- both of you are wrong: giving employees post-termination severance pay is not the same as sending valid WARN notices (which, if required, must
be received 60 days before the triggering employee separations occur). You can get off the hook only if the following is true: The company is facing unforeseeable business circumstances or a natural disaster, or the company has cash flow issues or capital access issues having an immediate impact on daily operations. It's very hard for ANY employeer to get away with not filing a WARN notice...
Severance negates WARN
It's called employment at will. And you also accepted severance, so I am pretty sure that would keep you from getting any sort of settlement.
