Surplus/Severance

Was informed June 22, 2023 that I was part of a surplus/severance with my last day on payroll being July 6th. I was management, always a high performer and never been written up for anything. I was also informed by my supervisor that he could not save me (thinking it was due to what I make). Two questions….1) Would the WARN Act apply to me being that I was only given 2 weeks notice? And 2) How long has it taken those that have been severanced to get their direct deposit severance payment? I know it said it could take up to 45 days but I was curious of your personal experience. I just contacted HR and they were able to inform me that my severance would be paid out on August 4th. For any of you that may be affected, I would encourage you to give them a call. Follow the instructions on the Surplus Transition Portal on what number to call and what to say. At least I now know when to expect it. Thanks all!

I've been part of planning process for management surpluses in my national group. I've never seen salary included as part of the process.

It's always been a simple listing of job functions and responsibilities, performance ratings, skills, and current accomplishments compared with peers. Who else in the group can take over your responsibilities also enters the discussion.

Never have I seen salary, age, or what you did in 1998 enter the process.

As to the WARN act question, I don't think it would apply to us, as there were so many locations involved for the number of people affected:

A plant closing (see glossary)—where your employer shuts down a
facility or operating unit (see glossary) within a single site of employ-
ment (see glossary and FAQs) and lays off at least 50 full-time workers;
• A mass layoff (see glossary)—where your employer lays off either
between 50 and 499 full-time workers at a single site of employment
and that number is 33% of the number of full-time workers at the sin-
gle site of employment; or
• A situation where your employer (see glossary) lays off 500 or more
full-time workers at a single site of employment

I was about to ask about the severance, myself. Was hit in the same wave (off payroll July 6th,) and they DID say up to 45 days - but was rather hoping it'd hit earlier. So far, no luck

On those employee surplus/HR calls there are easily 200+ people on those calls each time, which HR will tell you they those hold those call very regularly.

Huh? You don’t start networking for another professional job with a part time job at Home Depot.

Hopefully, you have a decent network in place when you’re let go. As a long time employee you should have many contacts that left over the years, old bosses, etc. Assuming that you’re not a compete a-hole it’s not difficult to build up a decent network.

Follow the checkout process to completely. Do not elect to delay your severance pay and set it up for auto deposit. I got mine in the last paycheck I received during the normal pay dates. If your last day was on the 6th they still owe you the previous 2 weeks of pay. So you should have gotten it in your July 22 final paycheck. If you don't get it by the Aug 6th payday I would be surprised.

Keep in mind, ATT has been laying off for years and they are getting down to just the good hard working folks. They are targeting the USA folks since they pay the others less money. It is just very poor management. Stephenson put this company into a lot of debt that only in only gets worse with increasing interest rates. Stinky doesn't have a clue. I pray you find another job. You may even realize. as I did, just how bad it was working for that company.

You have much bigger problems if you need the severance that bad. You should have been saving with a six month buffer. Nobody ever believes they will be surplussed.

I think it's being discussed here there are very specific requirements for warn act listings. I suggest you check your employment commission in your state it should have the requirements for it.

I have done everything that was asked, you may be taking my question out of context. On our call, they said it could take up to 45 days to get the severance. That was a hot topic on our call, questions were asked and we were told that was worst case scenario. If we were to sign up for direct deposit, it should come much quicker. I am just relaying what was said, so I thought I would pose the question here to see if anyone has ever got it sooner than the 45 days. Just trying to figure out what to expect or not to expect. Sounds like this wasn’t the forum to ask questions, but thank you to those who have politely responded.

You had to know there was a good chance of this happening. Keep moving forward. Sounds like your manager acknowledged you were overpaid for a long time. You should receive you severance in exactly 45 days. Why didn’t you confirm this during your last 2 weeks?

Mine took 45 days on direct deposit. And as for your manager saying they couldn’t save you that is a falsehood. They recommend who on their team to let go and the director signs off on it.

Sorry for your situation. You seem well spoken and intelligent, As you wait for your severance, if applicable. Get a basic part time job that puts you in front of people to network with. Your emergency saving should easily make up the difference. Best of luck to a new future.

I suppose my main objective is to find out the timeline of when my severance will be paid out. On the call that took place, they informed us 45 days was the worst case scenario and by signing up for direct deposit, it should come much quicker. I do believe they said it would not be within the first 7 days but it’s now been over two weeks. Unfortunately the bills don’t stop coming in while I’m scrambling to get a new job. Surely they know of a date?? I guess I will try and call the surplus support tomorrow to see if they can provide me with any other timeline. Side note: if you aren’t actively pursuing a job within the company come your last day on payroll, it should be a requirement for them to give you the severance payment at that time. Thankful I do get a severance but it’s absurd to think of having to wait much longer.

Name and UID? I’d rather not share that but I can tell you I 100% wouldn’t have made the post if it weren’t true. Almost 200 managers were on the call who were all part of the surplus/severance with the same last day on payroll date of 7/6/23. And to the wise guy saying to get a job, clearly that’s what I’m doing, I do have a family to support. Thank you for your thought out feedback.

I don’t know about the WARN act. But I know people that were given severance and it took 45 days to receive payment.
