Tuition Re-payment for TAP

Hello Everyone!

I am so desperate in seeking advice that I have to put a post out here. So in last week of January they had told I will be laid of in Q1 2027. I did not have to sign any documents, it just came through. About 2 months ago, they moved my end date from Q1 to Q2 with a possibility of being it Q4. So I took it upon myself to not wait around anymore with any hopes within the company. So luckily I was able to secure a better offer at a better place and yesterday I had put my 2 weeks notice in. Today during my 1:1 with my supervisor, he brings up a clause on TAP that if I choose to leave in my own accord within 2 years of finishing my program, I have to repay the money back. The clause was last updated in Nov, 2025. Also I did a masters in engineering program and not an MBA.

Now my question would be, am I legally obligated it back as I don't think at the time of getting this TAP approved, I don't think I really had any clue to pay it back? Has anyone faced this recently? Not sure what to do. I was not planning on leaving until they started playing with my life/ career.

The company has been burned before as several opportunists took advantage of lax policies to jump ship within one week of completing their MBA. Yes there were many incompetent Managers in HR and Controllers who allowed this. I think they have learnt their lessons now that the cookie jar is empty and the company's reputation has declined.

@OP both of old and new TAP always have repayment clause if you depart within a period of time.
From what I have heard they can withhold some part of final paycheck to offset this. They may also send outstanding balance to 3P collection company, which will keep bugging you for payment. After that the agency will send that to credit bureau and you will have blemish on your record and the collection agency will try to negotiate a repayment plan, which could be less than the full amount.

You can try consult lawyer to see if they can provide additional advice but you signed a contract with specific exit clause when you bailed the TAP you probably have to pay the piper

Just don’t pay it - some overseas will chase you down but will eventually give up

Do you have the original signed TAP form? Typically, there is a minimum service requirement or a repayment obligation may apply. Given that your end date was communicated and later extended, I would recommend discussing this with an employment lawyer. In your current situation, the company appears to be benefiting from both avoiding severance and seeking TAP repayment, which may not be equitable. Keep us updated!
