Companies that lay off employees should not be eligible to use the H1-B or any worker program. These programs were intended to allow companies to hire people when they could not find suitable candidate in the country and we all know how this has been abused. However, to actually be doing layoffs and retaining visas workers should be a criminal offense.

People that were laid off were not useful for the company, and people who were brought on h1b had some skills that other folks did not. What is the issue here?

Lot of folks on h1b get laid off too, oh well.
