Anyone laid off in Germany Munich

Any one from Germany, how much need to negotiate for 6.5 years experience in synopsys. please help me to understand some thumb rule to negotiate with HR.

In German labor law, if you want to challenge a termination (Kündigungsschutzklage) in court, you must file the lawsuit within 3 weeks of receiving the termination letter.

Not affected myself, but some colleagues (in another city in germany). Don't know which offers they received and I can't really give a precise recommendation, but some things to consider:

  • 1/2 monthly salary per year in the company (working as a student counts as well) is basically the minimum you'd always get if you go to court
  • But the offered severance should be quite a bit above this value if the employee has very good chances to win in court. The principle is simple, if the employer have low chances to win in court, they'd better offer more money to have the employee leave willingly...
  • Now, how good are the chances to win in court? I'm no lawyer of course, so take anything I say with a grain of salt, but I'd say very good. German law does not allow to just freely lay off whomever you like. Have a look at "betriebsbedingte Kündigung". Even if they have good reasons to lay offs, they would need to choose the layed off employers but certain social criteria, which they haven't done. But it depends on your specific job, if they completely drop the product you are working on, chances are probably very good for them...
  • All things considered, going for 2-3 monthly salaries per year might be reasonable, all things considered, but again, depends on your specific situation and I'm not a lawyer. If they won't give you anything close, then only option left is to go to a lawyer, I'd say
  • RSU are also a topic, but no idea how to account for that, RSU aren't that common in germany, so I guess there is not much experience how that factors into severances

Do you have a works council? If there is one, there is usually a collective agreement (Sozialplan) in place. Still, negotiating individually is worthwhile. Would you be able to share the compensation that were provided so far?
I also saw reports mentioning accelerated RSU vesting in other regions. Maybe it is possible in Germany as well?
