WARN Trigger November 6th layoff NJ

Anyone know how to find out how many people total (not names) were Surplus in the November 6th Layoff. Warn was not triggered but I know alot of NJ people like myself who were let go, trying to see whether total was over 50, have not signed my GR&W yet trying to see what is up with this first

@aq
So you did not take the severance? How much more was the settlement?

They bypass WARN with severance agreements, at least in CA.

I was Nov. 6 layoff. I thought I saw a total of 179 people on that 10/27 call. Everyone was retirement eligible.

NJ Warn act doesn't necessarily guarantee more severance. You have to have more than 26 years of service for it to be better because the current severance plan caps at 1/2 year while nj warn is 1 week per year with no cap.

Was told they try to get under the 50 number specifically when lots of > 26 year service people are being cut.

For anyone who is retirement eligible are marked in the system as retiring, not surplus. They have been doing it this way for years as a way to get around paying the extra 4 weeks of pay.

@aq

Was it worth it? How many times more was your settlement than your severance would have been?

They cut 49, next month they’ll cut another 49. See how that works?

You don't get it... They found a way around the WARN rule . Remember this company is built on ethics but they bent over backwards to define these office breakdowns as not applicable to the WARN rules. I looked into it, and found that "no surprise" that HR and they legal team worked on a way to be non compliant to WARN. that is why NONE of the past layoffs showed up. They have scams on top of their scams.

Find somebody over 50 who was surplus’d. They would have been given a sheet with everybody let go, their ages and their locations. It’s the law.

If you review that list you’ll see that the company “conveniently” peppers groups of more senior people across multiple locations and job titles too. All in an effort to hide the age discrimination. Same thing to avoid WARN.

Slimy ba----ds they are!
