Thread regarding Bank of New York Mellon Corp. layoffs

NYS warn act

Pretty sure BNY is violating that one. 25 people or more from a location requires them to notify 30 days in advance of layoffs or they get fined. I know of atleast 15 just yesterday and there were more releases monday and Tuesday as well. All out of oriskany alone and no notification on the nys site. 🤔

@cx+1k9f3qy03 They did that to us too in Philly. Was a long time ago, but they had graphs and charts with us at the center of the BNY universe lol. Fed us all lies just to keep us around temporarily while they figured out their next step.

@cr you can think how you want but they dont legally cover all basis. If they did they wouldnt allow certain staff to pull bs non stop before terminating in fear of getting sued. They have targeted xertain locations and targeted forced wfh staff. You think its legal for them to block promotions and other extras given solely because we are wfh status because of them? Thats what’s happening and has been happening. Oriskany sits closed and empty for two years owned by them while they bi--h about staff being home. If we dont atleast make an effort to call the bs out it wont stop and they’ll continue to get away with it. Find a lawyer who says they’re wrong and as a manager i will gladly sp-t facts that i know is happening to staff that they cant deny

Whatever the absolute minimum rule is to avoid legally reporting - you can trust that BNY is operating right on that line.

A serious question to all of you.
Why do you keep believing that Government - especially NY state Government of all bloated bureacracies- is going to somehow help or save you?
BNY legal has this covered and at the end of the day we are at will employed. Plus the Bank is treated like a handmaiden by NYS because it brings in substantial revenue. Not to mention all the business BNY does with the Fed.
WARN? It’s a joke and after the fact anyway.

This is the WARN act states:

  • Closings affecting 25 or more employees
  • Mass layoffs involving 25 or more full-time employees (if the 25 or more employees make up at least 33% of all the employees at the site).

So, as long as they keep each wave under 33%, they can get away with no reporting.

To the other person's question, and just relaying my personal experience here. (I'm impacted and my management has been pretty straightforward with me) The current scenario in my group is that all WFH are targets, not just Syracuse/Oriskany. Although they individuals did seem to be the first priority to cut. I've heard that a very small percentage will stay but not indefinitely.

@bv well what I was told was that upper mgmt has issue with anyone who is wfh. Not sure if its just them targeting oriskany for some reason or all others tok cause there are several. But the goal is yo not have anyone wfh even though they are closing offices and forcing people in that status

Forget the notification part . There are tricks available to bypass advance notification. But do tell us at least the groups that were impacted .
