Finally Posting - New Directive

I’ve resisted posting on here, but I feel the need to. I’m in a Management position, but not giving specifics out of fear. My Leader gave me a directive on Friday to prepare for the big Q1 WFR list. Here it is. We have to try to avoid cutting H1B people because we uprooted their lives to move them here, so we can’t leave them stranded. So I guess they feel it’s OK to uproot talented Americans’ lives instead of getting rid of cheap, inferior workers. Total BS!

@r2 Dell is doing small cuts so they don’t have to file publicly that they are making cuts. Sadly this gets them around H1B renewal and Green Card issues for their favored low income workers.

This is not believable.. Also whenever u go for h1b extension of these folks they will have issues. Also greencard cannot be filed if there were American citizens who had similar skill sets were let go. US immigration department does scrutinize things.

bring the press in, report it to the papers. Let it be heard. Contact professional protestors..if there is such a thing. This could be considered a democratic movement since you're fighting corporate America and the rich. There would be more interest in this type of news now based on all the unemployment of US companies going on. If you're going to do something and make it heard, now would be the time.

I got a similar message from my manager, but more subtle. It was that we have a group of people that we are able to pay less because of their life situation, and we need to keep them. It's not like they can quit and find another job easily in their situation. So we need to cut the group we have to pay higher salaries to. I agree with the OP that it is clear how they are choosing who goes. This company is doomed. MD is boosting the stock price with salary burden slashing and false AI promises so he can sell the company, at the expence of American jobs and their lives.

@ej Give 'em enough rope to hang themselves with. It's pretty easy these days to record people. It's just an app on your phone. Put your phone on record, and bait them with further clarification.

"I'm going through the list of cuts, and there's these 3 h1bs that fit our definitions. You mentioned on Friday you wanted to give the H1Bs a pass because of the potential to uprooting lives. I just want to make sure that's still the case. I'm won't that call on my own."

If he says anything short of "That's illegal, and I never said that" That'd pretty much seal the guys fate. If he says it's illegal, then you're off the hook.

You get the guy on tape, it's curtains. He'd at least get canned, and just this alone would likely create an investigation into the company to find if the practice is widespread. Widespread practices like this lead to 25+ million dollar fines.

@dt it’s not documented - they aren’t that stupid. It was a verbal directive/“encoragement.” Not really much different from past reality, just less subtle. Haven’t seen a single H1B cut yet - have any of you? The only (very few) Indians cut were American born.

If it's true, document it. Then rat them out. It's illegal to discriminate on citizenship status:

8 U.S.C. § 1324b(a)(1) — “It is an unfair immigration-related employment practice for a person or other entity to discriminate against any individual (other than an unauthorized alien ...) with respect to the hiring, or recruitment or referral for a fee, of the individual for employment or the discharging of the individual from employment —
(A) because of such individual’s national origin, or
(B) in the case of a protected individual (as defined in paragraph (3)), because of such individual’s citizenship status.”

(3) “Protected individual defined As used in paragraph (1), the term “protected individual” means an individual who—
(A) is a citizen or national of the United States

Again, document, and report. No point in posting it here. If they're doing it, nail 'em.

There is changes coming indeed however nothing you wrote happened as that would immediately result in HR action for discrimination

You made that up . Call if you got it , was likely for reduction of the costs with minimum loss of head counts - and that in fact would mean to keep cheapest resulting in H1B folks staying.

Your attempt to antagonize H1B folks is just subtle but dirty Trump'er trick
