8 hours in office legal challenge

If you are exempt and are told you must be in the office 8 hours get ready to document everything. It is very easy to prove not all are held to the same standard. Also very easy to prove this will disproportionately effect certain groups. Also make sure you let them know if they are saying 8 hours in office = a day then you cannot do work that day from home. If you do two days in office in a row be sure to leave your laptop locked up in the office so you cannot do any work after you physically leave the office. Document document document

Lots of harebrained ideas on this thread, including the OPs. not one of them has any legal standing

Go ahead, consult with a labor attorney. Ask if they would take this case being paid on contingency - that will give you the answer.

The end result of such a lawsuit, even if it were successful, would likely just be them forcing a one-size fits all standard of everyone must be either in-office or on PTO 5x per week, with an in-office day needing to be 8 hours in-office minimum without taking half day PTO. If they get in trouble for inconsistent rules, they’ll simply default to forcing everyone to adhere to the strictest version of the rule.

Anything at hiring is superseded by any change of policy. Unless you have an OC-level “contract”, your argument holds zero weight.

Your employment hiring letter also specifies that you are employed at will, and that the company has the right to change anything at their discretion,

All remote agreements (when they existed) had standard language saying that they could be terminated for any reason or no reason.

8-10 years ago, thousands of us were originally hired as a 100% remote employee, and there were written contractual agreements between Wells Fargo and all remote employees. They can't breach our contracts and force us to RTO.

Technology Director here. Confirmed this week in BE’s extended leadership meeting that preparations are underway to begin communicating a phased in mandatory 5 days in office. Waiting until bonus payout week to help lessen the blowback.

just remember that as an exempt employee, the more you work the less you make. The same reasons you can work a 60hr week and. kt her overtime is the same if you work a 30 hour week and still get the same pay. They can force 8 hours, but if you leave early, like after 6 hours then they can't hold it against you and still have to lay you without requiring you to take PTO. I'm always surprised by people who put in a 5 hour day and still use half day PTO. If I work 4 hours I do not use PTO if I need to sign off early. Now, I would love to turn in my laptop and only use the vdi machines but I'd only be short changing myself. If we don't like our work environment we all have the option to leave and find something better.

I think OP brings up some valid points. In our department, we have exempt people who are required in the office 5 days/week sitting next to exempt people only required in office 3 days/week. The roles are different but it is completely at the whim of management who is RTO 5 days vs 3. We also have exempt people who are required to work 50 hours per week sitting next to exempt people who only work 35. Salaries are all over the place. Just because Wells Fargo has gotten away with it so far doesn’t mean they will win if someone challenges them. (See every other Wells Fargo employee class action lawsuit where Wells was found to be wrong.)

Documentation of such issues is smart.

OP has no clue. They are just documenting their future dismissal. Leave your laptop at your desk over night = not adhering to BCP protocol. Saying 8 hours in so “ I can’t do work from home that day” = job performance issues & abandonment. Not all roles are the same. I know plenty of salary exempt people putting in evenings & weekends and 50-60 hours. Fyi life’s not fair.

OP - the company would simply be a better place if you were fired.

It would also be nice if this post was plastered in your resume as a cover letter for future job interviews so that other employers don’t have to be stuck with you.

I feel terrible for your manager. I wouldn’t wish this mess on my worst enemy.

When I looked into it (last week), every bit of legal advice I could find gives them justification to require exempt employees be at a specific location.
