File an EEOC claim anyways to bring pressure on TT and gang. You can file even after signing the NDA as this action is not prohibited and trying to retaliate would be against Federal Law. Elliott wont like these complaints piling up as the try to sell the company as these complaints will be attached and follow the sell

EEOC is a joke ... don't waste your time. I filed a charge after the five oldest members of my department were laid off due to position elimination even thought the positions were then filled with younger workers. Seems like a slam dunk but my experienced attorney said it is almost impossible to win these cases. Age discrimination cases are the hardest to win. Current employees are too afraid of retaliation to testify on your behalf so it ends up being your word against Windstream.

Please contact EEOC and file a charge of age discrimination against Windstream. If you are over the age of 40, you are considered a protected class. Please don't allow Windstream to get away with this discriminatory act.
You all need to make MM and TT nervous by asking them questions of how Windstream determine your position was being eliminated? Who approved the elimination? How come you weren't provided a 60 day notice? How come I wasn't offered to be placed Into a similar or comparable role? Why is the language on MM OWBPA ambiguous? Please provide each department or division unit from HR, retail to E&C mangers who were affected by this layoff.

DON'T take Megan's advice per the call on 11/28 to hurry and sign your severance package. They want you to hurry and sign it. If you were part of a group layoff you have 45 days to sign.

Earlier comment is bullseye. The company exists on life support of government subsidies. The best the execs could do was the shell game of bungled sale/leaseback that catapulted them into bankruptcy. Workers will continue to be laid off while the c-suite flails around trying different gimmicks to keep the game going as long as possible.

Who cares ! This place is only surviving because of 2 reasons. 1- government has deep pockets and threw so much money at telecoms to upgrade our internet infrastructure. 2- Elliot management group invest in failing bankrupt companies… gets them a pulse again and collects their profits and go onto the next victim. Windstream waste so much money it’s not even funny. They bring back construction crews and buy millions of dollars in equipment that isn’t needed or used and further more nobody knows how to use it anyway. They have so much dead weight in certain groups and they’re oblivious to what groups they are. If you want to get rid of people offer a real buyout to the senior employees that don’t really want to be here anyway. They know the back story from the bankruptcy and amazing the people that caused that still hold high positions and continue to make bad decisions and get awarded.

Engineering was hit, planners, Retail was hit hard. Stores closed, launch lane closed, no new stores except one in GA already planned underway, KW (director of retail gone), TJ (VP retail/D2D) gone. Funny cause they were letting all their employees buy designer jackets and have retail managers approving billboard contracts. The local marketing RMOCS are a joke too. Especially the GA one.

In Ohio you can be let go FOR ANY REASON AT ANY TIME. You are not special - Get over it. Sign the paper, collect your severance and get on with your life. Yeah yeah I know - everyone is p!ssed off..... and the dumpster fire rages on.

I just reached out to an employment lawyer for advice. I will update this thread once I have an idea if there are any actions that can be taken. Many states have different laws so you might want to check with someone local to your area.
