But let me ask anyway: do you know if it's ever happened here that HR did not side with the manager, but with the employee?

Need HR to help non-management employee? Non-management employee must do some homework. Take notes of manager behavior, note date and times. Summarize facts. Accumulate 3-5 incidents. Then, call ERP (mental health coverage). Discuss the stress caused by manager. Try to discuss on 3-5 sessions. Then and only then, confront manager. Take notes of interaction. Notify HR if any retribution. Meet with HR and explain past incidents (from your notes) and work related stress (backed up by ERP visits). Then HR will investigate manager and not you.

No, not when it comes to discipline and and here’s why.

Even if HR determines the discipline wasn’t right, they can only ADVISE that. They can’t force the “decision makers” to do anything. Basically they can say it was a bad decision, but they can’t reverse it. Only the person who made it can… and they are free to reject HRs advice. A long time it was taboo to go against the advice / recommendation, but today everyone is on power trip, and no one cares about anyone else’s opinion/advice.

If the manager has done anything illegal HR should address it. They represent the company, and want to limit company liability. They have no particular loyalty to any managers below he c-suite.

Nope. If you report them for ethics violations, you will be the one getting run off. HR is management and will always side with one of their own over an employee.
