Quotas were increased on the sales team RETROACTIVELY?

As in - they took money back that has already been paid?

This can’t be real. I hope this post is parody.

which says they are allowed to change the compensation plan at any time, including quota

Does anyone have the actual contractual language? What is claimed here is absurdly overboard - if true, they can constructively terminate anyone at any time with zero recourse. Pregnant and want to rid of you? Just raise the quota. BTW, that has zero chance of holding up in court

Why limit increasing the quota to just one year? The company could go back 20 years on a long term employee and drive them to bankruptcy simply by raising the quota. Talk about underhanded, sounds like something McElfresh would do.

I have asked this of the class action attorney that won 5 cases against AT&T and the answer is It is NOT illegal for 2 reasons:

  1. What everyone needs to understand: AT&T essentially blackmails sales into signing a "Document of Understanding" every year which says they are allowed to change the compensation plan at any time, including quota. So they can, and have and do, increase quota say in Sep and backdate to Jan so you now owe the company money back since your year-to-date attainment drops.

If you refuse to sign that Document of Understanding you are harrassed by management until you do AND you do not receive any compensation checks earned until you sign it.

  1. We are considered AT WILL employees. If you don’t like it (quota increases, treatment, policy changes, whatever) you can leave at any time.

There should be a suit to protect those who have given 10/20+ years , have good reviews, sales results = given 2 week notice and no resources except an email from HR - that you can not reply to. Don’t let the door hit you…..

I can splice 15 hrs of metered work in about 3 hours so I always worked my tail off until my sneaky little beauch of a don't know squat daughter of a VP came out one day and wrote me up for some wire that was at a terminal that I was working at THAT WAS LEFT THERE YEARS EARLIER that she found and I never saw. Well, that was until I drove up to my splice site and received a phone call from assignment and made the mistake of answering the call B4 I set out my safety cones and that same t.WAT wrote me up for no cones. On that day, I decided to splice ahead as usual and bank work for cold, wet, bad weather and on those days stayed in my truck all day and listened to music but still making over my work units.

$5million quota five years ago. This year it’s $45million. No travel, competitive environment, no training that’s worthwhile and customers are not fond of ATT because we treat them like sh:t as a corporation. Billing issues- forget about it- terrible. Adjustments- be prepare to wait until your kindergartner is out of college before you’ll see that credited to you account. But hey, if you are at all late paying your bill, we will make sure to start harassing you for payment.

I agree with OP! You can't raise the quota retoactively. It illegal, underhanded, and unethical. McElfresh is an id--t, he has no accomplishments over the past five years, he fails the "What have you done for at&t lately" test.

When I was in sales I crushed the targets, they raised the quotas to reduce my payout. 20 years ago.

Nice lawsuit? Nothing illegal about raising quotas, probably do half a** work to barely hit your quotas now that’s why you’re mad.
