Is severance still capped at 6 months?

I have been here 15 years and I deserve more. Is there an arbitration process when it comes to severance?

For a severance package is at risk compensation factored into the 6-monh dollar amount or only ones guaranteed salary? What if I'm exceeding my at-risk target when let go is that factored in as well?

Yes, the 104 weeks for certain tech titles hasn't changed, however, you won't see those techs with that severance benefit get laid off anytime soon. T just isn't willing to pay techs that much to leave.

When I was a Comm tech - legacy T approx 15 years ago severance was 104 weeks if you had 31 years service Pretty sure that hasn’t changed

Santone is trying to cut severance to 1 week pay per year of service up to 12 weeks. Just when we thought there was no other benefit to cut. This lady is scary dangerous.

Severance is pretty simple. Most of you it wrong.

If you are a bargained for employee, then severance is a bargained for benefit. Seems frequently mentioned as a success of the contract negotiation.
You need to look in your contract for exact details, or union rep for a casual conversation about how it might work. Stewards don't always have it right, so contract is the authoritative source.

Non-Bargained employees, as of Dec '21, not aware of any differences in legacy company. Flat out, 6 months only.

It appears, as one mentioned and a quick read, it appears New Jersey has a law on the books as of 2020, requiring 1 week per year of service

Ask for COBRA payments in addition to your severance.
You can also try to mention things that might embarrass them. They pay you to keep your mouth shut. Dont sign anything if you dont like the terms.

I am retired mgt, as mentioned by others, accept offer or decline. if you lose arbitration, remember you declined offer. You get nothing and company picks the arbitrator. FLSA (Fair Labor Standards Act) does nor require severance. State laws may differ. Their was no relief when severance was cut from one year to six months. Severance is common in business, but not law. Unless protected by a union, you are lost. For example, unions are guaranteed paid breaks. Management is only guaranteed that if a break is taken, it is paid. Only guarantee is a meal after six hours and not paid if over 20 minutes.

Case can not be based solely on tenure. If you can prove you deserve more for loyalty, you proved you are not legally owed more.
Only hope is if you are in a protected class or whistle blower.

New policy in the works to reduce the current policy of 6 Months severance. Most companies use 2 weeks severance for each year of service. I am sure T will use 1 week severance for each year of service with a 3 month cap. Just think of the huge cost savings.

It depends on which legacy company and state. Legacy PacBell is by far the most generous when severance is involved.

For management, in New Jersey, the laws have changed to require one week severance per year of service IF the layoff meets certain criteria for WARN. Prior to the new 2021 law I believe company capped severance at 6 months.

If you are non-management any "severance" is outlined in your contract for your particular company. When/if that is applicable is also specified in the contract for your particular company and those provisions will be followed, no more, no less...

If you are considered management , well....... hahahahahaha, good luck to you...

The severance is part of the "compensation" they pay you not to sue. You best have an outstanding legal reason, with lots of proof. If you can find a lawyer that will take your case, you can spend the next 10 to 20 years waiting for "justice" but you will probably die before you see a dime. And of course the lawyer will get the lion's share.
