Nothing wrong with someone suggesting that an attorney be consulted if an employee/former employee believes the company is doing something wrong.

Wow, with all the hysteria here, now you have ambulance chasers trolling the sight to find their next pigeon. Michael Bertolic is a benefits/ERISA attorney in Chicago.

How about you do your own research, which is where the info in the earlier post came from. There is this new invention called Google, you know. Or better yet, stop posting half truths and innuendo until something actually is announced. I get the place sucks and so many are overworked. No argument. While you guys do entertain me, for 6 months, this site has only offered insight to the paranoid and the galactically stupid. And now the sharks, like Bertolic are smelling blood. How about somebody bring some value instead of name calling and infighting within posts.

Happy Independence Day.

If you really think they did something wrong, I suggest talking to an attorney experienced with health plan matters. Try Michael Bartolic.

  1. Per ARPA, if you are eligible for another health plan, including retiree medical, you dont qualify.
  1. Involuntary terms are not eligible and since you retired, I’ll assume you also qualify for retiree med. Either way you don’t qualify.

Not here to defend company, just laying out government qualifications. So of course they want their money back

Who Is Eligible for COBRA Premium Assistance?
The COBRA subsidy is available to any individual who (1) had a COBRA qualifying event because of a covered employee’s reduction in hours or involuntary termination of employment and (2) is eligible for COBRA during the Subsidy Period. This group includes AEIs who had enrolled in COBRA prior to April 1, 2021; had enrolled in COBRA prior to April 1, 2021, but discontinued coverage; or had not elected COBRA as of April 1, 2021, and whose maximum period of COBRA coverage has not yet expired. The COBRA subsidy is not available to AEIs who are eligible for other group health plan coverage or Medicare beginning on or after April 1, 2021, even if they do not enroll in either.

They aren’t covering me. I was involuntarily terminated last August during their orchestrated terminations for “needs improvement” BS reviews. I won’t go into detail, but it was definitely orchestrated. 26 years of meets or exceeds, 1 year of lesser. Anyways, when I got the call, I went in and filed for retirement. They say I’m coded as 40, whatever that is, I’m assuming retired, so though I was involuntarily terminated, they found it convenient to code me as retired and are denying my COBRA ARPA payments. I’m guessing they’re still taking the government dole for the COBRA payments, yet denying payments to qualified employees and pocketing the money. They’ve hit a new low.

So what you're saying is that if you were given a benefit, Cobra $$ for a limited time or retiree health insurance, you should get to keep the double dip?

This is no joke, I got the email from them. We not talking about hundreds but in the thousands. If you qualify for retiree medical or was offered they want it all back.

You would think they could just let it go if it was their mistake.
