Severance & Unemployment

Chevron says they will not contest unemployment benefits, but state is saying that you will not be able to collect unemployment until “the time” you’re company agreed on in severance pay. So if I have been with Chevron 6 years (18 weeks pay) is that how long we have to wait after receiving the severance check to obtain unemployment?

Since when in any state, at any time, has receiving a severance after lay-off ever kept you from receiving Unemployment comp? The only thing I ever heard is a minor delay and the total compensation is not altered or changed, you get the same amount even when delayed due to severance. What a stupid thing to ask. That has absolutely nothing to do with Chevron either. No different than any other company I've worked at. Being fired is different. But this is not theBeenFired.com site, is it?

You can google for yourself, assuming you have half a brain. In California the state provides for unemployment as long as wages are not earned. Employers who paid certain severance benefits did so in hopes they would not also have to pay unemployment. The courts disagreed and employees received both benefits. Win win.

Oh, That's so nice that these terms are defined. In fact they have been for decades. The Severance payment that Chevron provided this year is also not defined any differently than past years. And in Texas and California, the Severance payment that Chevron pays to laid off and EOI employees does not preclude you from receiving Unemployment benefits, in case anyone still had any doubt, lol!

Severance is allowed in California, under almost any definition. California only has an issue if an applicant is receiving “wages”. Very different to Texas.

San Ramon employee here. No problems at all receiving both the Chevron Severance payment as well as Unemployment benefits. And yes, I answered the question correctly and honestly on the form, that I was indeed receiving a severance payment. You would be better off not lying on any official documents, but that's just my opinion, lol.

@qscv, I was working at the Houston office until I EOI'd. I receive both severance and unemployment. That's all I posted in my one post indicating that there was no problem. Not sure who you are directing your inquisition and accusations towards. Care to indulge the readers?

Wow there's really a troll on here who is intent on trying to convince everyone that The CVX severance that everyone I know from the Houston office received is not a severance? I am in Texas and had no problems at all with the unemployment department and telling them that I took the Chevron severance package, and still receive my weekly checks. It's quite awesome, I may add. Don't believe the trolls and nay-sayers. Texas has no problem with you reporting your actual severance, and the amount.

If you answered YES to severance, then you did lie as the Chevron legal payoff is not severance. Severance according to TWC is defined as a payment guaranteed in writing in your original employment contract, not an option offered by your employer under certain conditions. If the payment were an issue for TWOC, Chevron would be handling that directly with TWC as the administrator/payee on the unemployment.

I am also from the Houston office, and got severance, and get weekly Employment checks. Did not lie on the TWC form, and I put down "yes" for severance. I had no problems. When someone comes forth with some problems that they had, I'd like to know to let some of my friends know what to do. Appreciate any input that you guys can provide

You dodged a bullet if you mistakenly said the Chevron payoff was TWC severance (it's not). Others have been told TWC will not pay after they made that flub.

I am in Houston and received my Chevron severance, and am receiving weekly Employment benefit payments. No need to lie on the form, answer it correctly, that you have received a severance or will be. It will not affect your benefits. Has anyone had problems? Not sure what the issue is. If anyone has had any trouble, state your experience, or else, End of Thread.

I agree, those who don't understand that Chevron offered a severance to the ones who were cut, one and the same as what TWC defines as a severance below in that post :

Yes Indeed. thanks for providing that link. It ls crystal clear from that link that Chevron is Paying what is defined by TWC as SEVERANCE PAY. So it would behoove you to answer the question correctly and honestly and not commit Unemployment Insurance fraud if you are a Texas resident. I love visiting Texas and have a lot of friends there. @nwfk, Yes indeed, I am another happy camper who received a nice fat Severance check and also am afforded the luxury of being able to collect Unemployment checks weekly. Life is good. I am pleased with the SEVERANCE PACKAGE that Chevron is providing. It is so nice that they extended the SEVERANCE PACKAGE to 3 weeks/yr for eligible employees in this instance. I truthfully filled out my Unemployment benefits application pertaining to the generous SEVERANCE that Chevron provided to the laid off and EOI employees. I answered "YES" to me receiving a severance. I am also receiving weekly Unemployment Benefits from my state. I am grateful for that. I am not afraid of using the proper terminology for things, including races and genders of people. Using the correct Words does not bother me. I don't change that to please any particular type of person who is easily triggered or offended.

Question is not on application form, which Chevron approves. It is on the payment request form. As mentioned previously, Chevron is NOT paying severance. They are pay employees off in return for agreement to release them from legal claims.

As others have explained it is all in the terms you us. Even though it is referred to severance it is a lump sum payment and not a structured salarying. One is correct to say either that there is no severance or that your severance ended the day after you receive your settlement check.

I applied online and I didn't put down that I was getting a severance. Then I got a response that it was being held up, so I called them and they said that they found out that I was receiving a lump sum severance and I had to wait some time before I could get my benefits, after they determined that the severance period is up. They also reminded my that answering any question incorrectly on the inline form is fraud. I wonder how they found out that I was getting a severance?
