Do management employee's get paid for the full year of unused vacation when laid off mid year? or do they only get accrued vacation up to the month off payroll?

District 9 bargained for employees receive who are surpluses or take an offer receive their Full Vacation and Personal Days off, it is not prorated.
This issue has been brought time and time again. The Union confirmed and AT&T validated.
If you’re management then it’s prorated. I’ve asked HR about this and if you use all your vacation prior to leaving then what? Answer was.. it’s highly discouraged but AT&T won’t charge or deduct you for it. So it’s safe to say when a surplus is looming try to take as much vacation as you can.

Yup. I was glad. Took my 401K and my lump sum and invested the well in to 7 figures $$$$. Enjoyed my full pay STD for 15 months, then my LTD til I'm 65-which means I'm still on the payroll. Making a ton on the market. So please work some OT..I need the $$$$. TY for your concern.

Vacation payout is based on accrued earned & unused vacation days at last day on payroll.
On the other hand, there doesn't seem to be any explicit rule against using up one's entire annual entitlement before termination date.
I went on disability after 41 years. They put me on a 3 month "job search" which pushed my retirement date out til March 2018. I retired, and got a check for well over 7K for my 6 weeks of vaca. It was not prorated. I
Well, I’m management (yeah right). But I have always heard that the company does not pay out unused vacation.

I was notified of being surplus in January 2020. My last day at work was March 10th. As a second level, my vacation time was prorated at 9 days for 2020. I was domiciled in the Midwest and not the west coast. It would have been nice to get the 30+ days of vacation but it didn’t happen. I left at the right time and then the pandemic hit! Folks, the deck chairs to the Titanic are starting to float by! Have your back up plans and resume updated!
For bargained for employees, it's in your contract. May differ between districts and may be based on how many years you have.

I was paid for my entire 240 hrs of vaca I never used.
For unused vacation time, it would be prorated based on last day on payroll. BUT...
In California, employers are free to advance vacation to employees, but they cannot deduct advanced vacation from a final paycheck if an employee leaves earlier than expected. For example, if an employee has only one week of accrued vacation, but takes two weeks of vacation and then quits, the employer cannot deduct the week of vacation from his or her final paycheck.
I have heard, but I don’t know if true, that you get a prorated amount of vacation time. But what if you took all your vacation time before you are surplused? Do you owe the company money? Will they take it out of your last paycheck?

this question is asked so often, what do you think? if you have not accrued the vacation time - do you REALLY believe T will GIVE it to you?
