Thread regarding AT&T layoffs

Its time for us to Organize to win!!

WARN Act clearly states the 60 day notice can be bypassed given unforseeable business circumstances and if its violated, there's a 500/day penalty for the employer.
It also states that we must be told why the 60 day notice is being bypassed.

In McElfresh's Organzing to Win email, the paragraph that mentions the 14 day window clearly states : "For management surpluses, we will institute a new 14-day exit window in most cases because there will be a limited number of alternative roles."

This does not state, "due to COVID and unforseeable business circumstances" which is what the WARN act requires.

Therefore, by their own admission they are in violation of the WARN Act!

Every person surplussed should bring this up to HR/Legal as a valid complaint, and then file a WARN Act violation.

There's power in numbers and if enough of us do this, we shall get our 60 days!!!!

Lets Organize to Win!!

People have most certainly been paid off by AT&T for being let go. I know of a case first hand when the age discrimination card was played and the company settled to keep it out of court. It was a sizable settlement and occurred in roughly 1998. It may be rare, but I assure you it happens. It doesn’t hurt when you have a son who is a lawyer.

I will be switching my cell plan to Verizon. My relatives & friends are doing the same. AT&T cancels me, I cancel them.

I am so tired of hearing about this WARN thing. No one cares. It isn't applicable. They get around it.
Get over it. Move on with your life.

Get over it. Find a job with a growing company instead.

They officially announced reductions June 1st. So if they really arent going to violate this warn act, then they will do cuts after July.

In AT&T WARN really does not apply anyway. Management policy give 60 day notice and all bargained employees are covered under the bargaining agreement. Also, AT&T rarely meets requirement due to not laying off enough people in single location.

Good luck with any class action lawsuits! The only people that get anything out of it are the lawyers. First, it will take decades to get it though the courts. You will be dead before there is a judgement. And T usually manages to win them historically. And if there were a settlement, you would get a few dollars for your trouble. The lawyers will get millions.

I would consider the 14 days a mercy k–l. Get it over quicker. Besides, there would be no time to train your replacements in India!

Good suggestion. AT&T is definitely trying to ignore the law and hope no one challenges them!

Never if the fact that they basically announced these lay-offs were coming last year. It's been planned for and is clearly not Covid related.

This is a great opportunity for a class action lawsuit.
