CA WARN Act
https://edd.ca.gov/Jobs_and_Training/Layoff_Services_WARN.htm
Note: Executive Order N-31-20 (PDF) temporarily suspends the 60-day notice requirement in the WARN Act. Visit COVID-19: WARN FAQs for more information.
For questions regarding the California WARN law, contact the Department of Industrial Relations.
My associate director asked me to put everything I knew in an excel file 3 months ago. Told me that everyone on the team is doing it. I checked and everyone had no clue what I was talking about. Did my associate director ever get the excel file? Nope, I said it was a form of training and documenting - I asked to get a pay differential since it was outside the scope of my job duties. My AD didn’t reply to my statement and left it at that. If they let me go at least I take the knowledge with me. I’m not giving you the kitchen sink!
If anyone gets surplussed I suggest stop all work immediately and focus 100% on benefits. I would not burn one calorie on anything that would benefit the company.
QUITE INTERESTING!!! https://www.brown.senate.gov/newsroom/press/release/brown-demand-answers-on-atandt-layoffs
“The elected officials will be all over T if they claim its COVID and no 60days notice”
And.. that will do what for us in the coming weeks. Good luck to all tomorrow.
The elected officials will be all over T if they claim its COVID and no 60days notice.....
The WARN act has exceptions for “unforseeable business circumstances” and natural disasters; in those cases there’s no need for 60 day notice.
The WARN act does not have a policy to replace a severance with the 60 day notice. An employer can pay you a minimum of 60 days but you must get 60 days. If T tries to avoid the 60 days lawsuits will start...Will be interesting tomorrow to see how they will handle the WARN act. I expect many elected officials will get calls...
State laws are 60 days OR a severance. Guess which one you're getting.
Looking at Management Severance Plan now...indeed, on first page: "amended and restated as of July 9, 2020".
At a quick glance, I am unsure what has been changed. Still 50% for 13 or more years, per schedule of severance allowance (section 1.5).
Will T adhere to state laws on 60 days?
Go to HRonestop and search 'surplus' or 'severance'.
where do we find the videos?
Entire document has been updated. Some info has changed, but hard to find all the differences. The new plan includes DirecTV as a participating company. Also increases COBRA medical costs from 100 to 102%.
Also, they revamped the mgmt surplus resource pages on HROneStop as well. There are videos detailing the 14 day process, FAQs, etc. Much more info; doesn't make the situation any better tho.
14 day and wacked!
