Do I have to sign RIF papers right away or do I have time to consult with an attorney first?

HR told me that even if I was retiring, I still had to do the unemployment process or I wouldn't get my supplemental pay. But, I'm not in one of the states with a lot of worker protections. Maybe that's true in CA, but not where I live.

@rqq+1vvVyElP laws change. It's best to understand exactly what your rights are and have it explained to you by someone who is acting in your best interest. We all know the company is acting in their own best interest, not ours. I personally don't want to leave it to Elevance to explain to me what my rights are. That's like having your opponent give you strategy tips in a competition. Why would anyone do that? We have a free consultation available with an attorney through our Anthem Cares (not sure of the exact name) benefit. Maybe it's worthwhile to talk it over with someone in advance and be ready. We can do it on the company dime. 😜
@ecx+1vvVyElP. Retirement eligible for me was 50/10 50 years of age, 10 years if service. Yes that is correct you will not have to apply for the state unemoyemnt as a supplement. You will however be Able to open a ' cIaim' with the state unemployment after your severance is over. This is what I was granted by executing retirement benefits. . It determines how Elevance health communicates to the Unemployment dept of your state. So all my severance was fully paid by Elevance for the entire duration, then I got another 6 months ( max inmy state) from unemployment. When Elevance combines the payment of your salary with the unemployment dept, you are no longer eligible for more benefits after that. Make sure to take of your insurance needs after the severance runs out.
@kgn Being eligible for retirement - meaning age 65 and over with at least 10 years of service? It is my understanding that is the only way you can get Supp without having to file with the state unemployment office (unless the rules vary by state). Are there any differences in Supp payout if you are 62 and have 10 years of service?
If your over 62, running it by an attorney is well worth the $300 or so. There are laws that protect age discrimination. For sanity sake, well worth the $, for me at least. I plan to if I get the notice. Good Luck.

Make sure that if you're RIF'ed but eligible for retirement, your RIF gets handled as such. !
Anthem will NOT do it for you. You must request it.
Depends on your age. 40 and up get a little more time than those I’d er 40. Federal law.
Lol attorney... what are they going to do beat up the bully? Ever hear of right to work laws? They don't even have to give severance, but they do it based on proper advice. You ever see attorneys advertised to sue employers for layoffs?? I didn't think so and their is a reason for that, any attorney will promise you the moon while your paying their invoice..Take it say thank you and expand your skills and move on to the next company.
You can’t sign and send in until on or after your actual termination date. Assuming you got 30 days notice you will have time for an attorney to review as your term date would be in December. Don’t know if it’s worth consulting an attorney as I am sure EH legal has made sure these agreements would stand up to lawsuits.
