@s6 if contract signed in NJ. If contract signed in other states or Canada it follows common and case law proceedings of fictitious rights of employee. Remember a law suit is an invitation to settle. Talk to an employment lawyer before signing away rights. By the sheer number and timing it can be proven their was no intention of upholding the contract in the first place

Here’s the clean version:
Vacation / PTO

Legal to withhold, unless the employer has a written policy or contract promising payout.

BONUS

Must be paid if earned/contractually owed.
Does not have to be paid if discretionary or if the plan requires active employment at payout time.

So is it legal?
Yes, it can be legal in New Jersey—depending on the company’s policies and the employee’s contract.
If your ex‑coworker had written policies guaranteeing payout, then withholding could violate NJ wage laws or create a breach‑of‑contract issue.

When a company the size of D&B makes a decision to blindside 100 people half of which are close to retirement age that company is not worth loyal talent. Top it off position eliminate two days before month end dropping everyone’s health benefits, not paying accrued vacation and withholding 2025 yearly bonus payouts that the employees worked hard for…This is as low as a company can go. Hoping when they decide to hire again zero high level talent applies knowing how they treat their most important asset “the employee” @D&B you could have done this much better!

@jy lawyer up. They do not want any bad press. That is why they avoided WARN notices. They do not want the layoffs made public nor do they want publicity around India or china taking jobs.

@ar any way to get them to payout that bonus? Crazy that it’s a 2025 bonus but they can avoid paying it after we worked the whole year!

  1. Cost
  2. What can be out sourced
    3 Productivity (monitoring)
    4 AI use
    5 other arbitrary criteria

I was laid off. I was told, it was a business decision, no fault of my own, my position was being eliminated. Any insights from anyone as to how the decision as to who would be laid off was made?

This is the big one ClearLake has been waiting to do. Right before bonus money would be paid out next month. It is hitting all across the organization, both US and overseas.
